The AR-10

If the lower won't fit an AR10 upper, it can't be called a variant.

The modern .308 AR rifles are all considered variants of the AR-15, not the original AR-10. Pretty sure the existing upper doesn't fit on an AR-15. The original AR-10 isn't prohib by name, but rather because they're FA or converted auto.

You build a rifle that's based on the AR-15 design platform and use parts that will interchange with it then it's going to be deemed a variant. Look at what happened to DLASK with that pump rifle.
 
I'm well aware of the AR15 parentage, but if a newly designed upper will not fit the AR10 or AR15, it is not a variant regardless of parts commonality.
