Thoughts on 12.7 individual qualification

Hey all,

So of course we all like those little pistols a former govt decided to prohibit.
Younger guys like me born in the late 19*0's don't qualify for one of those fancy 12(6) licences uh?
Discrimination by age uh?? No fair. It is what it is.

But I still want the opportunity to own a few of those ingenious little works of metal art.

So..... What about 12(7)..... Yes, I know it's pre-1946 handguns only, but hey.

Let's have a look at section 12(7) of the Canadian Firearm's Act:


Next of kin of grandfathered individuals:

Section 12(7) A particular individual is eligible to hold a licence authorizing the particular individual to possess a particular handgun referred to in subsection (6.1) that was manufactured before 1946 if the particular individual is the spouse or common-law partner or a brother, sister, child or grandchild of an individual who was eligible under this subsection or subsection (6) to hold a licence authorizing the individual to possess the particular handgun.


After reading that and considering my family situation, I can state that as a single guy at this time, the only method for me to pass a 12(7) transfer and acquire a qualifying prohibited handgun is if I was to become "common-law" with another 12(7) licence holder around my age. All the other options listed have been ruled out in my case.

(That 12(7) licence holder that I would be "common-law" with would have received the prohibited handgun through their older 12(6) family member)

So.... A long story short, how could I meet the "common-law" status with another 12(7) holder and begin a transfer?

A while back I called the horse riders with regards to the definition of that kind of relationship and what proof may be required.

I don't see any " open boat" what ever that is .
Look up what common law means.
Over the years, I have found a lot of RCMP members don't know what the firearms regulations are , unless they are into shooting sports.
I don't think any one wants to stick their neck out because you want a small pistol.
 
Sooo… for a common law relationship, why do you feel that you have to find someone your own age? This is the woke peoples republic of canada. Take advantage of it. What’s to say you can’t be in a same-### common law relationship with a 70 year old dude?? Who could then pass on his 12(7)‘S to you? The liberals have shovelled all this s*&t onto us, so why not take advantage of it????
 
My wife (I was tempted to write partner for $hits and giggles but that joke has gotten old...) has a different last name from me. We do live at the same address though. No proof of any kind was ever asked when processing a transfer. (That's how I have a p08 with both matching mags registered to me) No proof was asked when transferring from her dad to her either for that matter.

So... why don't you just look for the right woman instead of trying to do something bizzarre? One with a still alive 12.6 licensed parent - then he can buy all the guns you want with your money and pass them to her and you... Some people's definition of the 'right woman' involves hair colour and boob size, yours just involves the length of her gun barrel ;)

Looking for individual with a stash of at least 12K of primers and > 100lbs of various powders.

You'd have to have a lot to offer :p (I have 30k+ of primers stashed ;) )

My wife does speak fondly of having another woman to split the house chores with. Must cook well. :p Frankly I thought I'd have to offer my body for this, but maybe I should have thought of the prohibited permissions instead. So... I can have full auto... I'd say "send bikini pictures to apply" but I can imagine what some of you jokers might send :p

I don't know if adult adoption is a thing in Canada, but I understand it's common in some countries, specifically for inheritance purposes, including inheritance of titles.

Another possibility is a business license. Who knows, you might even be able to develop a profitable sideline. If the business is incorporated, another advantage is that a corporation is immortal. Since the government undoubtedly wants to discourage people from going this route, it's time to contact a lawyer if you want to try it.

The really complicated part is being able to show it's a legitimate business with clients and income. Good luck with that... The corporation may be immortal so the license will pass with it to heirs or new owners but it can have its license not renewed (hypothetically).
