Hey Guys

I have a question I searched but could not find the exact answer.

My one tree stand is about 50yds from our property line and the game trail it over looks runs on our property then crosses a fence on to our neighbors land. Where I would be open to take a shot is about 10yds from the fence and the Deer will most likely follow the trail.

The Question is do I need permission to track and tag my kill or is it my responsibility? The land owner will not let us hunt his land we have already asked. I cant find anything in the regs but I could have swore it said some where its the hunters responsibility to track and tag his kill but I cant find it.

If you cannot hunt there, you cannot persue game there either.
As such, I would suggest you relocate your tree stand.
 
I'm not sure if the law is the same in Ontario, but in Alberta you need to have permission to have access to any private land.

You could ask him for permission before something happens. failing that you might be able to secure permission to trespass from the local warden. best you check out either option before shooting.

He's already been denied hunting access, and the CO's cannot trespass or authorize trespassing against the wishes of the land owner.
 
Ok so I called the MNR and you guys are right you need permission but the CO can also grant hunters the righ to pursue wounded game. The CO would call the land owner and explain and try to sway them to let us retreive the game if that didnt work the CO would come and retreive the game for us.
 
The best bet is for me to go talk to the guy he isnt an asshat or huge anti he just does not want people hunting on his property I'm sure he would be ok with us retreiving our game.
 
True - pretty tough to make the case for the ethics of neck-shooting with a bow (and lung-shot deer can go a lot farther than you think).
 
Most every landowner is responsive in a positive way if you want to retrieve a shot animal that ended up dying on their land.

Those types of landowners are usually an unsociable type who seem to keep to their privacy, which I can understand.

As stated above, a CO can be called to help find and gain access to property that the landowner strictly forbids trespass on.:cool:
 
Well I was at the Belleville fish and game club for the pre-season regulation updates read by our local CO's last week and this question came up....

The CO's said they have never had a land owner refuse letting a hunter retreive their game he went on to say its the hunters resposibility to retreive their shot/wounded game for the ethics alone.....Me personaly I couldnt sleep at night knowing I killed an animal that now lies rotting in the woods cause some anit refuses access to retreive it.
 
Maybe it's just because our farm has so many trespassers on it during the gun hunt...but I have little sympathy for these guys. They are usually the one's from the city that handle a gun one week a year. I have found guys wandering around in the middle of our 365acre farm following a blood trail. I asked them what they had shot, they said they weren't sure but it was BIG :eek:. Royally screwed my afternoon hunt.
If people ask to recover a deer on our property, i first ask them to show me where they were hunting...if there are no casing/blood/hair on the other side of the fence, they are SOL. I will follow the bloodtrail myself and tag/recover the deer myself.
As for asking a CO. Good luck finding one, and they wouldn't want to get involved in it. They can ask, but the decision is mine, and mine alone.
Moral of the story...make sure it dead on your side of the fence. :)

I'd have to agree with beefman, setting up 10 yds from the property line is asking for a lost deer. I'd move the stand...

If the CO's are busy or not around, the animal will spoil anyway.
