Transfer of ownership for .357

Hi All,

i'm a newbe here and realy like the sight...just finished my non-restricted and restricted courses and exams and am looking forward to getting my very own first pistol..... (a Glock ofcourse...hehe).

My question is....i have a friend who's brother passed away i an accident and was the owner of a few hand guns. His brother...my friend, has ownership of his brother's entire belongings. Here's the scenario. The SQ ( surete de Quebec) sent him a leter asking him to either turn in the gun (or acount for the gun by being a member of a club or something like that. My friend does not want to have the gun melted or given to the SQ but wants me to have it...he previously had his FAC a long while ago with his bro and i think he would have to redo the courses and exams again.

How can he transfer over the gun to me after i have recieved my PAL? Basicaly that is my inquiry. Does he need to go and get his PAL again or can he just notify the SQ that he will be transefing the gun over to me? I would appreciate any help on this matter. Thanks

Is the brother (your friend) the executor of his brother's will? If so, he can tell the SQ to bugger off, because the guns are part of the estate.

Also, assuming that your friend got the letter from the SQ; he has been accepted as the rightful owner of the guns (licensed or not. Is not the question).

When your RPAL comes in, it should not be a problem. Call the CFC 1 800 # and have your friend tell them that he is transferring the gun into your name. Then you can talk to the person on the phone to verify the transfer. Sometimes you might have to make it two separate phone calls, but it can be done in one.

-You have to join a club
-Your friend, being the executor of his brothers will (I'm assuming) can store the guns until he sells them or has them disposed of.
-Your friend must start the transfer to you by calling 1-800-731-4000. They will give him a reference number.
-Then you confirm your information by calling that number with the reference number

In the mean time call the Canadian Firearms Centre at the above number to explain the situation.
They have to give you reasonable time to complete the transfer.
At worst a CGN from Quebec can take possesion and hold them for you.
 
The only problem that you could encounter is that the .357 revolver has a barrel length less than the 105mm , about 4 1/8 inches and is a prohibited firearm. If it is a prohibited firearm it can be sold to someone who has a GRANDFATHERED 12(6) on their RPAL allowing them to possess prohibited firearms, but unfortunately not to you. But go get your RPAL quickly, so you can maybe take advantage of this opportunity.
 
Thank you all for your responses...they are very helpfull, and thanksfor being so quick. Do you think that by my friend wanting to pass the gun o to me, they would give me my RPAL quiker? just a thought...would be nice though. Usually how oong does the PAL take to come. I completed my test this past sunday. Should i start the process immediately? Thank u all so much

There are a lot of factors in how long it takes to get the actual RPAL card. Sometimes there are long transit times in the mail both ways, sometimes it can get buried on the desk of some beaurocrat puppet who could give a crap if and when you get your licence. There are background and reference checks that they do most of the time. You should get it in the mail TOMORROW. I did a poll recently on this here, and the times varied from 8 or so days, to over 60 days. So time is of the essence. It took me 50 days to get mine. I would suggest sending it priority post and double and triple check each and every box on the form to be sure everything is filled in correctly. Make sure you get a picture done that is the correct size. (A friend of mine sent in a picture that he had done himself because he didn't want to spend the 15 bucks to have it done at a passport/photo shop. The picture was not satisfactory to them and they sent the form back. It took him a total of 88 days before he got his card)
And no firearms officer will issue a transit permit (which you HAVE to have to even take the firearms from your friends house to yours, if you dont have a range membership, unless you can prove you are only gonna be a collector and not a shooter)
