Troy Industries Law Suit

Fair is fair.....if you screw someone for their property then go to hell....do not pass go and do not collect $200.

Troy Industries wins $505,000 Verdict against Samson Mfg.

June 21, 2007, Boston, Massachusetts.

Today, a Suffolk County Superior Court jury awarded Troy Industries, Inc., of West Springfield, Massachusetts, a $505,000 verdict against Samson Manufacturing Corporation and Scott Samson, individually. The jury found that Samson violated the Confidentiality Agreement it had with Troy and that Samson wrongfully used Troy’s trade secrets and confidential business information. The jury also found that Samson engaged in unfair and deceptive business practices in violation of Massachusetts General Laws, Chapter 93A. The jury’s finding that Samson engaged in unfair and deceptive business practices entitles Troy to an award of its attorney fees and costs.

The trade secrets at issue were for Troy’s ideas, inventions, designs and drawings of the Modular Rail Fore-end, for which Troy was recently issued US Patent No. 7,216,451. Also at issue were Troy’s designs and drawings for the Forward Handgrip and its Scope Mount. These products are Troy’s designs for accessorizing the M16 rifle and carbine used by our military in training and in combat abroad, including the Middle East.

Troy is a designer of military weapons and weapons accessories. Stephen P. Troy, President of Troy Industries said, “This vindicates me. The decision of the jury clearly shows these were my ideas, my designs and my inventions from the very beginning.” Damian R. LaPlaca, of Donovan Hatem LLP, Troy’s lead trial counsel, added, “This means that when you steal somebody’s trade secrets and ideas and try to pass them off as your own, you’ll have to pay.” Troy was also represented at trial by attorneys Sarah K. Willey, Troy’s General Counsel, and Christian G. Samito, and law clerk Emily Coes, each of Donovan Hatem, and was further assisted by patent counsel, Ann Lamport Hammitte, of Lowrie, Lando & Anastasi LLP.

The jury also found against Samson on its claim that Troy breached a purchase order for the machining of the Modular Rail Fore-end, and awarded Samson no damages


I would no piss on either #### Swan or Scott Samson if they where on fire. Its blatant theft -- I dont buy knock off #### since I feel that the inventor is owed something for his efforts.
By supporting Pirates you make it less and less likley for others to go forward with new designs - since there is no profit from all their hard work.

Keep in mind that Patent and Copyright laws are designed to keep these people in business -- and expire after periods.

Okay so who does own the patent since three companies are making the same attachment design? Samson, Troy and MI are basically the same, is there a lawsuit against MI?

See..this is why I need to read up on product more. I wholeheartedly agree.

I take this point of view pretty seriously. While in the states I was made aware that Target does not support the troops in any way shape of form. I actually took some articles of clothing I bought there back.

#### em. Sure my little bit of busines probably doesn't make that big a difference, but I know guys that have small struggling businesses, and how hard it is in that particlular niche.

It not right.
 
You know, this is BS.

The law caught Samson doing something wrong and they're going to get punished. Fine.

I've got two beefs with the direction this is going:

1) Flow of information.

Now I follow CGN pretty regularly and this is the first that heard about how evil Samson is for copying Troy's product. Some of the heavy hitters here may have been in the know and elected not to buy Samson on moral grounds, but I suspect many are in the same boat as me and this is the first time they've heard about this.

2) Availability.

I've got a Samson mount for my Aimpoint and its staying on my AR. I would have bought a Troy mount, but they don't make one. I would have loved to buy a Larue mount, but its easier to get manna from heaven then LaRue products up here.

I suppose those that sell Samson products like ArmsEast are now less desirable than lepers.

End of the day I'm keeping my Samson mount (until a LaRue comes up anyway) and I'll buy from ArmsEast again.

I don't agree with Troy's supposed decision not to sell to dealers who sold Samson, and Smgcon and I will continue to support Armseast.

The thing is that a lawsuit was mentioned like three years ago when Samson first introduced their stolen rails, and everyone sort of forgot about it, probably considering it the same thing as Bushmaster/Armalite/Colt AR15's. Now that something has actually happened with regards to that lawsuit, it's coming back to the surface.

And Troy does make Aimpoint mounts.
 
I would support a company in their fight to keep others from infringing on a copyright law...only if they made their product available to me for purchase. If they don't, all bets are off and I'll purchase one from another manufacturer.
