US Export Restrictions for Scopes?

You are in the "catch 22" predicament. Canada Customs does not care that you have purchased gun parts or ammunition that are permissible, as long as you declare it, but US customs does! US laws states that no "non-resident alien" can be in possession of firearm, their parts and ammunition while in the USA. This has been in effect since 9/11. While you are there you are subject to US law, and if your are stopped at a US customs random check BEFORE you can reach Canada customs, and they find this stuff in your vehicle, you are in DEEP trouble. The minimum they will do is confiscate it and give you a stern lesson on US law. Depending on your attitude, you may be banned from entering the USA again. Is it worth it to try and bring it across? Is there some sort of master list of what can be bought and carried on your person and one that details what can be shipped?

Have it posted somewhere on CGN and then say bye bye to all the mystery and misinformation, otherwise these are just exercises in mental masturbation...
 
I've ordered Talleys direct from the States without a problem.Value is less than $100US,but I suspect they have an export permit in place as well. Mur

US export permits are generated for a single end user, not generic so as to ship to anyone.
Unless you supplied Talley with a Canadian IIC , US form DSP83 and an end user certificate, ALL of which is required in order to get an export permit from the DOS, they were shipped without an export permit, hence illegally by US law.

Several companies in the US have done this in the past and with rather nasty results. IIRC Midway got nailed for over $100000.00 a couple of years back.
Most US suppliers have been warned and are very hesitant to cross paths with DOS, hence it gets harder to get stuff legally from the US.
Not all US dealers/manufactures are licensed to perform exports, in fact finding an exporter is a trick in itself as many have been closed down by costs that the DOS now assesses, and the fines for minor paperwork fubars are significant.
 
I just found there are so many guys are selling scopes on Ebay. Lots of them are willing to ship to worldwide include Canada. Will it be a problem to buy scopes on Ebay? Btw the sellers have good feedback.

I've tried many times to get a scope from ebay until I finally figured out why. Really sucks.
 
A person certainly does not want to be carrying resticted gun related parts around in the US. They are serious about their laws, however anything any company can bring into Canada you can bring in as well. Al you need is the proper paper work, completed properly. I think the large corporations, would love to have governments' restrict everything, from binoculars, to refrigerators, so that the average person would simply not bother. Companies like optics planet can in fact get the paperwork to export scopes, but they don't. Why? is a good question maybe they just don't want to bother, maybe there are agreements made with the manufacturers, which prevent it. I have my own thoughts on this subject. The US government has not outlawed the sale of guns and related items to Canada. They simply have processes in place to monitor just what is going where. This is the permit process. The stuff being discussed is not on any banned list. I can buy a scope from optics planet have it sent to an exporter I know of, and then have it permitted and sent to me. All legaly.
 
I should also ad in that circumventing the proper process is ilegal, and should not be done under any circumstance. If done and tracked, you could be easlily be found, and in violation of both Canadian and US law possibly. Do it by the book, but don't think that you can't do it, just because you are not a corporation with some special permit.

Since 911 almost everything firearms related has come under much tighter controls. Also since 911 the US Dept of State has been tasked to become more financially self supportive so in that vein have introduced license fees to manufacturers, further increased the fees to exporters and added some MAJOR teeth in the way of fines and sentences for export infractions.

Over the last few years the number of licensed exporters has declined due to some of these new rules and restrictions as well as costs.

In some ways I can not blame someone for not wanting to do exports from the US as to get hammered with a 100K fine for some minor paperwork glitch that may not even be within 1s personal control would make me think long and hard about doing any exportation.
The rules for exporting seem to vary dramatically from exporter to exporter depending on where they are located as well which I still can not figure out, :confused: it seems there is a lot of personal interpretation of the rules given to those who administer the rules by the DOS.
 
There is so much misinformation on this topic (along with the "ammo" topic) it is unbelievable.

Perhaps the good folks at CAMERALAND, who are in NY State, and advertise on this site, could fill us in on the fact?

They won't ship scopes I tried!
 
Yes, that company can legally ship scope rings to Canada, with the following conditions;
  1. Wholesale cost of the order is under $100
  2. It is a "non critical" component (not a scope gun, frame, barrel, etc, but the list constantly changes)
  3. Exporting company must report the export to the State Department. (They don't need to apply for a permit for that shipment)
  4. Manufacturer of the rings must also have the annual export licence
