It's really not. The RCMP have clarified that magazine capacity on auto shotguns is dictated by the largest shell it can chamber. It might get attention, but it's 100% legal. It's in less of a weird grey area than AR pistol mags, and way less than the 10 round Turkish pump action mags. (Not that either of those are outside of the written law :))

That’s not quite what I said. I said that using unusually long 3.5” shells as your basis for pinning to 5.9 to try and get more shorter shells in the tube is maybe not the best idea. If they can buy a box of off the shelf 3.5” shells and get six in the gun you are going to have a hard time.

Gotcha.

I recently blocked a magazine extension for a shotgun to hold 5.5 rounds of 3" so I can fit 6 rounds of 2.75" and I erred on the side of caution and bought a box of every type of 3" shell I could just to double check. The variance between the longest and shortest shells is so minor it probably would never affect mag capacity of the bigger shells when limited to 5.9 rounds. I have never heard of anyone having issues with this, or getting into legal trouble with it.
