well since its a bolt it can be as much as it wishes to be, But if the magazine can fit into anyother rifle it has to be at 5.

What he is saying, The mag is ment for a AK so it can only hold 5.
 
Actually that is not correct.
So long as the mag is found in the rifle it was purchased for the mag can be a 30 round mag. If you are caught with an SKS-D with a 30-round mag in it thebn yoiu might be in some trouble.

I already went through this with the IPSC guys.
Some semi-auto rifles can accept a 1911 mag that must be pinned when in a rifle but not required if you also have 1911.

You may be asking "Does that make sense?" The answer is no and nor does our federal firearm legislation.
