Thanks for all the reply guys. I have an old set of Burris rings I believe and the other are cheap ones from Amazon. Both for the 11mm dovetail and both have been on previous rifles with no issues.
The rifle was new although purchased on the EE. All indications would lead me to believe that this reputable member was being honest and the rifle was unfired. The barrel was loose, to the point I could move it back and forth. I torqued the action screws to 32 inch pounds tightening them evenly.
I can confirm that the scope was installed correction with the elevation turret at the top and the windage at the side. I have owned 10 - 15 rifles over the years, all with scopes and I've never had a problem. I think we can rule out installation error although I have installed scopes sideways in my newbie days.
I did think the dovetail may have been cut off centre. I had a Mauser 96 like this (drilled and tapped off centre by a drunken gunsmith years ago) and I fixed the issue with angleloc rings; however, in that case I could not get the rifle boresighted without running out of windage so I knew that the mounts were off centre. With this rifle I am able to line up the scope with the boresighter (or simply looking down the bore with the bolt removed) yet the rifle was shooting way to the right. Adjusted windage all the way left and it was still not on target. Its almost as if something is causing these rounds to be spit off to the right but I cannot come up with an explanation for this.
I'm going to go out one more time to see if I can get this thing shooting properly. Otherwise its going back to CZ to be fixed or back to the original owner.
