Tax on used pistol

I recenty bought a used pistol from a licensed dealer Ontario. I live in BC. They charged 12% tax. Are they supposed to charge provincial sales tax on a deal bought in another province?
 
Yup.

It could have been worse, you could live in Ontario or Manitoba and pay 13% or god forbid PEI, Newfoundland, New Brunswick, Nova Scotia, and Quebec at 15% (Quebec has to be weird so they're actually at 14.975%).
 
They charge the tax of what ever province you're from. Someone from Alberta would only be paying 5%. However if you're from Alberta and visiting BC and you only want to pay the 5% tax from your province, then they have to mail the firearm to your residence. Would you rather of paid the 13% tax that Ontario has?

The seller's obligation to charge and remit provincial tax is determined by the legislation from the province the seller is located in: in this case Ontario. Of course, their may be obligations from the buyer's end as well. Anyone here in BC have to pay BC PST on a dirtbike from another jurisdiction? Argh.
 
they over charged you. They should only have charged you 5% Gst since bc does not have hST. Demand your partial refund.

OP got charged properly.

I think you misinterpreted that.

First off, there is the word "generally". This applies to provinces that charge GST only or HST. Then this will be the case.
Secondly, "If you operate in", refers to the vendor being in BC, which it is not.

As a vendor in ON, you cannot charge BC PST unless you are registered with the BC Provincial Gov't to collect and remit BC's PST. That may be the case, the OP never mentioned who the vendor is. If it was Cabela's for example, then the tax charged was correct. If it was a shop who only has operations in ON, it is highly likely that shop is not registered to collect BC PST.

Simply reading and posting the text from the link is not sufficient. There is more to it.
 
Why the confusion?

If an Ontario business is not doing ALL of the below activities they don't need a bc tax number. No tax number, then the business can't collect taxes which they can't submit.

Here's the tax rule

British Columbia

You are required to register to collect PST if you regularly do all of the following:

Sell taxable goods to customers in BC
Accept purchase orders for taxable goods from customers located in BC
Deliver taxable goods to a location in BC
Solicit persons in BC (through advertising or other means) for orders to purchase taxable goods

You are also required to register to collect PST if you regularly do all of the following:

Sell taxable software or telecommunication services to customers in BC
Accept purchase orders for taxable software or telecommunication services from customers located in BC
Solicit persons in BC (through advertising or other means) for orders to purchase taxable software or telecommunications services

Your posts are totally unsubstantiated. As Doors, CanAm and I indicated, if they are not registered to remit PST (no tax number), they cannot (legitimately) collect it. How could you possibly know if they are registered.
