I'm laying off a bunch of employees that work for the other 20% of the business as their accounts dont make any money and I was paying 60k a year out of my pocket just to keep them employed.

Where abouts in Florida? I use to have a nice pad on Longboat Key.. nice area for a beachside house. BTW, when you gonna post the "list"? to get the sale of the century started!

Look at your Green Card requirements very carefully via residencey dates...

It's easy to get around all the immigration BS if you have Canadian citizenship because you don't need a visa to enter, and it's even easier if you're self-employed.

Just set up a corporation, put all the money into the corporation, make yourself an officer of the corporation and then pay yourself a dividend. Then you're not employed there, you're living off investment income. Not sure it would hold up in court but they've got to catch you first. Plus you don't have to pay into social security, no point if you are still paying CPP. So you don't need a social security number either.

I know people with UK citizenship who have done similar, they just set up a small hotel in Orlando or something, enter on a B-1 visa.

The real problem they had was getting Florida ID, but Florida law has an exemption for Canadians, you can get a Florida DL for two years. They set it that way because of the TN-1 NAFTA provisions.

The only real snag is that you end up paying more tax because dividend payments are not deductible against corporation tax the same way that salaries are. But it depends on how much money you make as to how big the tax hit is. And if you own a hotel, you can write off all your household expenses against the corporation anyway because you live in the hotel.

To get my Fla Dl, I had to prove I belonged. You just can't drop in and turn in your Cdn DL.

EVERY time I enter and leave the US (okay its via an airport) I have my passport scanned in.

If you just want to live in the US on and off fine -- but you need a "Alien Registration Card" for you Dl - and a DL to buy guns -- and both to get a CCW - and both and a CLEO signoff for the "good stuff" Title II weapons.
 
Looks like you'll still have to pay Canadian taxes - ouch! Its still a no-brainer though. Hold on to your health card - just in case you get the sniffles!
 
With dual citizenship you must still have a primary address. However then you can board hop.

Tax issues -- for Cdn citizens living in the US - you pay tax in the US on your made in the US $ - and tax in Canada for any Cdn earned $. Its the one exception for usually US cit and residence have to pay taxes on their worldwide income.
 
My understanding is that if you hop between Canada and the US with this 6 month cycle, you are still considered a CDN resident and you are taxed on your worldwide income by Canada. On the other hand, Canada and the US have tax treaties so that you wil be able to claim tax credit for the tax you pay in the US.

If you start as a Canadian tax resident (not the same as a Canadian citizen), a temporary stay in the US will not qualify you as having left Canada for tax purposes unless you do a lot of specific things, such as give up any permanent residence here, give up your health insurance in Canada, etc. Canada zealously guards its tax revenue.
 
Sorry I had condensed the residency requirements when I said the primary address.

As soon as I was told I no longer entitled to get Canadian Health Care -- that was when I was happy they where not going to be able to tax my ass...

10 years from now when I am old and ill, I will likley regret all this..............................................................................

I specifically went into the DMV and asked this question. If you have Canadian citizenship and you have a local address, you can get a Florida DL, the only difference is that it is only valid for one year. The reason being that Canadians don't need a visa to enter the US unlike every other alien. I thought the reason why they did it like that was because there are so many Canadians who have holiday homes there, but I discovered on further investigation that the reason was because of the TN-1 entry requirements (you can enter for one year to work). As far as snowbirds go, they assume you will remain a resident of Canada.

All States pretty much have the same provisions now due to 49 USC 30301, enacted in 2004, which basically requires States to check the residency status of people applying for DLs, if they want the DL to be accepted by Federal authorities as valid (so in other words, if you walk into the Social Security office and want them to accept your DL, it has to be issued in compliance with the Federal standard).

As for tax issues, that's a very long discussion, it depends on your circumstances. If you are resident in the US for 183 or more days, you are subject to US income tax, but yes there are treaty provisions, it depends on what your job is, how your company is structured, etc.

Regarding the magazines, I understand the mags have to be marked LAR15. Couldn't you buy a full length LAR15 mag in the US and have it blocked to ten? I believe you can do the same with other standard capacity pistol magazines.

But then its not a 10 round pistol magazine is it then... its a blocked down rifle magazine : )
 
No, its should still be just a blocked down pistol magazine. I'm pretty sure the RCMP/CFC memo stated marked as LAR 15 magazines, it didn't state overall shape or length.

Actually it did, it specifies that they are a distinct magazine. That means that they have one or more characteristics that define them as different from similar rifle mags, it's not just that they're marked differently - in the case of these particular magazines I believe that the distinct characteristic is their overall length, which is non-standard for rifles.

b) The cartridge magazine for this handgun as manufactured by C Products LLC is not an adaption of a magazine designed and manufactured for use in a semi-automatic rifle.
3. The design that has been found acceptable as a handgun magazine is held by the RCMP, Firearms Support Services, Firearms Reference Table Section as a "pattern". This particular design and NO other design is approved for use as a “handgun magazine for a handgun commonly available in Canada”.

Those two items above are from Questars web site (hope you don't mind Mark but it bears repeating, I suppose) These magazines form a class by themselves, any magazines which do not exactly meet the pattern do not conform to that class and will therefore be treated as prohibited devices. This could mean jail time for anyone caught with an illegal magazine.

People should just pay that 35 bucks to Questar for doing all the work to make this happen instead of trying to cheaping out on that 18 bucks a piece to creatively block their magainzes. Things like that irritate me - people spent all the time to do all the difficult work, and some people try to save a few bucks to get around and reap the benefit. Kinda remind me of the Chinese people who shamelessly copy stuff without paying a single penny, or trying to copy a design with a name change Why will people import interesting stuff or even work with the RCMP, if they know they are not even going to be benefitted for their time invested?? Stop being so cheap - reward those who put in the hard work.
