Many .40 S&W handgun mags are perfectly usable in 9mm Luger pistols. These magazines will hold an extra 3-4 shots. For example, the Beretta 96 .40 S&W magazine will hold 14 rounds of 9mm ammunition and functions perfectly in Beretta 92 pistols and Cx4 carbines. Not only is the extra magazine capacity handy, IT IS PERFECTLY LEGAL!

In a letter dated July 9, 2007, RCMP Senior Firearms Technologist William Etter states, "The Former Cartridge Magazine Control Regulations are oriented to the possession of Cartridge Magazines. Once a cartridge magazine is acceptable as a magazine for a "handgun, commonly available in Canada" and is capable of containing ten shots or less of the kind or type for which the magazine was originally designed, its further use in any other handgun or any other calibre cartridge is not regulated.

The use of a Heckler & P7 M10 cartridge magazine in a Heckler & P7 M13 firearm loaded with 13 cartridges of 9MM LUGER calibre, in our opinion, would not constitute a violation of the Former Cartridge Magazine Control Regulations."

This is great news for pistol shooters. Canadian shooters have envied our American cousins since the onset of our silly magazine restrictions came into force. Now it appears, there is a little light at the end of the tunnel.
 
Hi cap mags are not legal. Using Glock as an example, you can load 12 (or 13) rounds of 9mm in a .40S&W 10 round Glock magazine. This 10 round Glock magazine is not a hi-cap mag. Its still a low-cap as far as I'm concerned.

A regular Glock magazine holds 15 .40S&W (I believe, but wouldn't know since I can't seem to load any more than 10:p). A high cap Glock mag holds 31 rounds.

Your title is misleading.

Your title sounds like the makings of a Toronto Star headline.

I don't mind the 10 limit - it forces me to practice reloads, and slows the pace at which money pours profusely out of my wallet...
 
actually one of my beefs with beretta pistols is their weight/firepower ratio with limited capacity mags. if they get 14 9mm in a 40SW mag this might change my opinion..

Not really the point... You can still choose to load only 10 in your full capacity mags if you wanted to do more reloads etc. Hell you could load 5 into your 10 rounders if that was your goal. The point is we should at least have the choice of full capacity mags.
 
isn't this type of "loophole" best kept relatively quiet if one wants to keep it as a loophole? this is canada - if you get too excited, the gov't will step in and take care of that for you...

not long ago, i saw a similar loophole / oversight / ambiguity get quickly "taken care of" by the gov't proposing an update to the relevant laws. those laws would take a "i can live with and potentially overcome this limitation" loophole and make it a "well, fawk me sideways yet again!!!" loophole.
 
Well, an XD 40 mag would hold 11 9mm, feed fine, but not always hold open.

Generally all 40 cal. mags will hold 9, ussually to the tune of 1 more, 2 at the most. Do the math, add up the height of a stack of 40 cal cases, then divide by the height of a 9 case. It's not 4 extra, 1. (you might get two if its a sloppy home pin job)

It's legal, its a loophole, and its generally not as reliable as a proper mag. For any competition you'll be held to 10 rnds anyways, and if all your doing is making noise, learn to reload faster:D

A G22 mag might need a bit of love on the feed lips to get it to hold 9mm ok, it'll still work with .40 after so no worries there.
this is not new and the RCMP are fully aware of it. calling it a loophole is wrong, it's a workaround, just like the 10 round AR mags (you guys have heard of those right?).

I will call his an exageration also, you can fit max of twelve 9mm rounds in a 40/357 Sig mag.
