We need a subject to put this to the test.

Having a loaded antique handgun in a hunting environment is most likely going to be deemed hunting with said gun. I'd run it past my local LEO first.

I was stopped at the famous game check (Hwy 97 - Cache Creek) and was asked if I was going hunting. I was in camos at the time. I was asked to produce my hunting licence and said I didn't have one, and didn't need one to drive on a highway.

The response - "Pull over here, Sir. We're going to confiscate your guns."
The CO and a RCMP type asked where my guns were. I said locked up in the back of the truck.

"Why don't you have a licence?"

" I do", says I, producing my then valid BC Prov. Firearms Licence. "I'll be renewing my hunting licence in Williams Lake like I have for the past several years."

This caused some consternation as they wrestled with the matter, finally letting me go with the admonition to be sure to renew my licence before hunting .....

Don't rely on LEOs having knowledge of the law, wisdom, or common sense.
Most were raised in the post-PET anti-gun era.

Don't rely on them for anything. The quality of the officers is dropping off remarkably as more emphasis is placed on politically correct recruitment. Talked to a cowboy wearing a uniform at a check stop last december. He was "ethnic", and he couldn't find my address on my vehicle registration. The fact they can breathe and aren't white males is all the qualifications you need nowdays.
 
For the last 3 year I had my antique pistol on my leg when I am hunting. (32 rim fire)

And for the last 2 years I had my colt 41 on my belt and .32. Sure most of the time when a ranger asks you whats that. I tell them “a 100% legal antique pistol with all the paper work if you want to see it.)” Never had them call for backup or try to take it away. All they say is sure let me see the paper work. And then they let me go.

If they ask me y I have it? I tell them it looks cool and I like it. And its 100% legal so y not? You never know when you will need to shoot that stump on the ground.

(I don’t say I use it for bear defense.)

In the name of Science, it might be a good idea to perform a ballistics test on a whitetail cadaver, after the hunt. If you see the bullet causes devastating damage, then you know you are good to go in terms of the capability of the antique cartridge.

That settles what I'm using to finish off the next roadkill.......

It's under the "Firearms" section in the Hunting Regs Summary (2nd sentence)....you can't hunt with handguns or full-auto firearms.

Try reading the rest of the regulations. There is a disclaimer saying that they are a summary and one should refer to the act. Now refer to the act. The act specifically states that restricted and prohibited firearms may not be used for hunting. Antiques are neither. Nowher in the act is the word "handgun" used. I posed this question to a lawyer with the NFA and am awaiting a response.

That's interesting. I looked in Manitoba's The Wildlife Act and they take a different approach, they basically say what you can hunt with:

Hunting other than with firearms

23 Except as may be otherwise permitted by this Act or the regulations, no person shall capture, kill or take or attempt to capture, kill or take a wild animal, other than a fur bearing animal, an amphibian or a reptile, by means other than a rifle, shotgun, cross bow or bow and arrow.
 
In response to the original question, In Ontario I believe it would be legal, but only during a valid rifle season. During a muzzleloader season you must finish your deer with a muzzleloader. Case law here in Ontario has proven that. A local guy wounded a deer with a bow several years back and went out the next day with his shotgun to finish it off. Cost him a 5 year ban and some pretty heavy fines.

Good for you!I read a similair story on an American forum where the guy was hassled by a CO at the local diner while having an early breakfast in camo and he basically told'em to pound sand."I'm in town having breakfast,not hunting at the moment....now GFY!":D

That said,in all honesty I'd just as soon stay on the local LEOs good side and probly co-operate with nothing to hide.....but it's the principal of the whole thing I guess?
 
More of the Manitoba regs:

"While hunting during the muzzleloader deer season, a hunter may not possess any other device (except a crossbow) that may be used to kill big game."

Maybe you should slow down and reread the laws of your own province before you get in trouble.

No I would not ! Too many grey areas for my taste all to be proved in court at your expence if you run into the wrong CO.
 
No thanks, as much I enjoy shooting an antique on the farm this seems like a less than optimal solution to this scenario.
 
I wouldn't even pack one while hunting (antique revolver), let alone dispatch a deer with it. I've known too many RCMP that were so anti-gun, they could have been the offspring of Wendy Cukier and Allan Rock. The RCMP often accompany the CO's out here, inspecting firearms at roadblocks. An observant CO might just notice a big hole in the deer, and a little hole between its eyes, and start asking questions. The anti gun cop will only see a handgun, and you could end up with a big lawyer bill. Maybe even worse.
 
Well all I am going to stay is I am not going to stop packing it when I am hunting.
I never yet. Have used one to put down a deer. Never had to. They all dropped in there tracks, and buy time I get there they where dead. And I can reload my gun in less then 20 sec’s so I would do that before I used my antique. Seeing it takes way to long to clean my antique if I shoot it.

i started this post to see more Less what other would think about this idea.

I carry my antique for bear defense. If you’re hunting with back powered and a bear runs after you. You got one shot and if you miss your dead. Well with the antique gun you have 6 more shots.

Also 4 year ago. When I was hunting deer. I got some what attacked By a DEER all I remember is I was playing with my deer call walking down the trail. And heard a sound witch I thought was a bear. So I turned around and started to walk away and then I seen maybe 10ft from me around a turn a big 6 point bucks “bucking a doe” lets say I did not know what to do so I picked up my gun and started to point it at him and then right as I started to look into the scope he jumped off and jumped towards me witch made me drop my gun. And let’s say we where in a stand off for maybe 5 sec him stomping his feet. Then he jumped towards me so more. (Now he was maybe 4-5 ft from me.) So I ran like hell maybe 20 yards looked back and he was no where to be seen. So I went back got my gun. Cleaned some of the swamp mud off it. And then started to walk back. And then I saw him 100 yards away. But my scope had too much mud on it to take the shot.

If I had the antique gun I think I would have pulled it and let him have it. I think that day if I would not have ran he may have attacked me. And maybe killed me.

Since you already know that shooting a deer with a handgun (antique or not) is illegal in MB, I'm not going to bother reading the regs in YOUR province for you to double check that its also illegal to shoot big game with a rim fire..... or see if its illegal to carry two (or three if I'm reading your post correctly) firearms that are loaded at the same time when hunting (considering that has been illegal in the last couple provinces I have lived in).
Hey, I'm all for you *legally* carrying your antique- don't get me wrong. Matter of fact I'm 'in the market' for one myself, but using it to shoot big game in MB (and many other provinces from what I can see) is clearly against the law so how about not wrecking a good thing??

As far as being attacked and killed by a deer.... start a deer defence thread! :D :rolleyes:

At a club meeting, a CO said the following after fielding a lot of "...what if..." questions:

"Hunting is a sport for ethical people. If you hunt with a good ethic, we are never going to have a serious discussion in the field."

'Nuff said. Boils down to not doing something if you can't live with the consequences. That includes packing a pistol, antique or not.

I gotta wonder - what's the problem in finishing off a wounded animal with the firearm you first hit it with? The cost of another round? The beast doesn't care if you first hit it at 50 or 500 yds.
 
"...flintlock repro qualify..." No and neither does any other antique handgun. Flintlock or otherwise. There is no provision in the CC that exempts antique handguns from the 'at an approved range only' regulation.
