I appreciate the gesture Throttle but I'm not sure there is any way to fight it and win.

If they are going to re-class it, then it will probably fall into one of these categories (taken from the CFC website)...

What firearms are prohibited?

The Criminal Code defines the following firearms as prohibited:

* automatics, including those that have been converted so that they can only fire one projectile when the trigger is squeezed;
* handguns with a barrel length of 105 mm (4.1 inches) or less, and handguns that discharge .25 or .32 calibre ammunition, except for a few specific models used in International Shooting Union competitions;.
* rifles and shotguns that have been altered so that their barrel length is less than 457 mm (about 18 inches) or their overall length is less than 660 mm (about 26 inches); or
* any firearm prescribed as prohibited -- These can be found in the fact sheet listing restricted and prohibited firearms.


Which one do you think it is? The answer is obvious, and how do you defend against that argument?

The way I see it the problem is this:
Someone at the registry originally classed these rifles as restricted. Then someone else at the registry decided to review the classification and realized that they f@cked up. Now they have a handful of rifles in private hands.

They should at least compensate the owners for their original f@ck up. I bought the rifle basically with the approval of the Government. It's due to their f@ck up that I'm in this mess. I couldn't have bought it if they had classed it properly in the first place.

Disclaimer - Do I agree with the thought that these rifles may be prohib? No, I don't. But the Hasslewander decision give the FRT Lab a lot of leeway in making classification decisions. I may be wrong though, I'm not a lawyer. And this is all speculation at this point, who knows what they'll do?
 
yea man its retarded, if its a current military use rifle or a variant of one they seem to automatically make them illegal or restricted or prohibited. ARG!!!
 
Clobb, I think it's a winnable case. I don't know #### about law, but Paul Morrison does, and he had mentioned he thinks it's winnable. They revoke certification and serve notice, you can appeal it. Gun stays in your hand. We don't know if this gun meets the hasselwander criteria.

They could be bullying t97 owners hoping none will fight it. Remember they haven't even given canam a sound explanation. They're hiding something.

If they are hiding something how do "we" force it out into the open?
 
In court I'm guessing. They even blacked out the explanation in canam's freedom of information request citing some "national security" bs.

That reeks of lies. They don't have #### to stand on and they know it, why else the secrecy? If they had a strong case they would make their data known to canam at least.

What are they going to say in court? "judge this gun fits the prohib classification but we can't show you any evidence because of national security"
 
So if they are hiding something(we know they must be as you say) then going into court requires full disclosure on their part? and that would reveal their duplicity and more or less wreck their case correct?
 
Yes they would have to disclose their evidence in court. They might win, they might lose, but by t97 owners not challenging it, we probably will never know.

The problem is it costs money. No one man/woman can afford this on their own. If clobb does challenge it, he deserves our financial support. If 1000 cgners gave 10 bucks, that's 10 grand.

There's 60000 cgners and millions of gun owners in Canada.

Look at it this way, wrongway's dog broke it's leg. In a matter of hours, thousands of dollars were donated by cgners.

If we did that with important court cases, we would be unstoppable.
 
I'd be willing to chip in what I could for that kind of a challenge, wouldn't be much on its own but $10.00-$20.00 each at 1000 CGN'rs would be a bit of cash towards the costs
 
As would I. I would give as much as I could afford to. There are many other that would as well.

I guess we will have to see what will happen on the 17th of march. Keep us updated clobb!
