I hate trespassers....

Maybe he needs a mentor and a friend to teach him hunting ethics,You have the opportunity to mold the youngster in your image ......

I invited him out last year with us and even offered to loan him a muzzleloader for the hunt (he has a pal but no gun) but he didn't want to come out. I don't even know if it is actually him though.....
 
People like this ruin it for other hunters and make it hard to find good land to hunt, as when people do #### like this land owners get mad and just dont let anyone hunt the land.
 
Yeah. The landowner has told me to make sure that nobody else hunts his property and to kick anyone I see off the property but when we asked if we should call MNR or OPP he said he doesn't want to. :( If it's the guy I think it is, I kicked him out last year and explained the situation, I even gave him the property owners name and contact info so he could ask for permission and he never has. He's just a young kid and only bow hunts but this explains why we're not seeing deer on that property.

In Ontario, under the TTPA, that gives you the OK to act on the owners behalf. Get it in writing, then you can start taking action.
 
It sounds more like he is pissed because someone is trespassing on posted land, to hunt out of his blind.

Well using the blind is a #### move, but if the landowner is not willing to do anything, there is nothing he can do. Unless he follows ALLs London's advice, but I am not sure how the trespass laws work in Ontario.

Unless it has changed significantly since my years in security (about 7 years ago), here goes:

- a person is trespassing when they enter, remain in or engage in a prohibited activity on private property. All of these can be defined by fences, signs, etc. In Ontario, a board with a red circle painted on it designates no entry/private property, as does anything with the words including 'no trespassing' and 'private property'. Funny enough, DO NOT ENTER doesn't count.

- the owner, or person authorized by the owner can determine, designate and define what is or is not allowed.


- a person may arrest without warrant (CCC494) anyone whom he finds committing an offence on or in direct relation to his property.
- this includes (2b) people authorized by the owner to act on their behalf.

By these definitions, if you have been authorized by the property owner to act on his behalf regarding trespassers, and you have both defined what a trespasser is (not him or you), you have the authority to arrest that person for trespassing and detain them, using any force reasonable and necessary, until the police show up.

It's important to note that if you do arrest someone, you must deliver them 'to a peace officer forthwith', which means as soon as possible. Ergo, if you arrest someone, call 911 or your local number immediately. If it takes them an hour to show up, that's their problem, if you waited 10 minutes before calling, it's your problem and the whole thing goes because you didn't make a proper arrest (that's a story for another time)

As previously posted,I would be inclined to set up a fake camera, with a real one hidden where it won't be seen. The fake camera might keep him out, or it might result in him stealing or damaging it to hide his identity and his actions. If he does any damage or steals anything, then you can pursue criminal charges.

Agreed, but still if the land owner is unwilling to do anything there is not much that can be done.

If theft or vandalism to the OPs property occurs, the OP himself can press charges, even if the landowner does not want to get involved.
 
You could always tell the kid that you've reported him to Conservation already, and they're just waiting to find you trespassing before they lay criminal charges.
 
Dude just past a letter inside the Blind. Remind him that he's welcome to use the Blind and land with the land owners permission, but he needs to obtain it first. Seeing as you have already dusted for prints have a picture of him entering the blind and the police are waiting for a better shot of his face when he leaves the blind today. In addition the "hunting that he's doing on "no trespass" ( yes he's now been warned) land is akin to poaching and really spoiling your investment in and enjoyment of the hunt.
So Either get permission at the house and leave your name, so we can hunt together, or GTFO and never come back or he risks being physically, forcefully removed and face charges from the province.

I meant friends with the land owner. If it was my place and I said I'm not getting involved, I don't think I'd appreciate someone who I gave permission to calling the cops for trespassers.
