Not sure what legal excuse you have for that, care to explain why you will keep legally purchased property of your customer? Unless of course you subtract the cost of restricted barrel from the price.

You bought it, it's yours, and there is no law in Canada that says it's illegal to ship a short barrel to someone who bought and owns it.

The only controlled barrel in Canada under CCC/FA is a handgun barrel shorter than 106 mm, which is a prohibited device. The rest of barrels are non-controlled items.

This 'holding' has no basis in law.

If you have no RPAL, what are you going to do with a NR BRS-99 and quick change restricted barrel?

Is there any basis in law? Probably not, but it's definately a grey area we'd rather not get into if we value keeping our FBL. It would not be a wise move on our end either way.

We are readily divulging this condition as a term of sale (not as a surprise or anything); if you don't agree to this term you are not obligated to purchase the BRS-99 in this configuration.

Like the poster said before; we are simply holding onto it; ready to ship to you at no charge when you do get your RPAL. If anything it may encourage some shooters to get their RPALs; which is good for the cause at the end of the day.

That's a reasonable approach, people don't understand that you're trying to avoid trouble, for your customers, and yourselves. Guys, it's like selling a suppressor kit, and claiming it isn't breaking the law until you assemble it, so why worry? Because that logic will draw unwanted attention to law abiding parties. If you want to push the limits, do it yourself, and don't expect a business to want to risk everything over the principle of it. There are several grey areas to our firearms laws, and I wouldn't risk my income without a little clarity from the courts. Be understanding.

Your customer might need those few bucks that the barrel is worth and sell it, but you are usurping control of the barrel. Or they might use it as a gift. Or turn it into a barrel insert for another firearm. Or throw it in a river.
With friends like this, who would rather bend over backwards to satisfy imaginary requirements of anti-gun CFC bosses, who needs CfGC?

If he is holding your barrel I'm sure he can do for you what you'd like including selling it on consignment to someone with a RPAL. Not charging a holding/storage fee is nice of the guy.

Very simple.

The seller sets the rules for sale. They've been very clear and totally up front. Has nothing to do with law and everything to do with commerce. You don't like it? DON'T PURCHASE IT. Pretty easy to understand.

If you don't have an RPAL you can't buy the restricted version. If you want the Non-rest version and you don't have an RPAL, you don't get the short barrel. If you do get your RPAL at a later date, they'll ship you the barrel.

It's pretty simple and you're making things difficult.

Not a chance, if it ever was to be banned it would cover all variants too, for the simple fact of quick barrel change from R to NR.

Moot anyway, I don't buy things to worry about what may happen.......That's a losing game that nets NO satisfaction.

The point is one is registered, and the other wouldnt be. One is extremely easy to go after, and the other is a logistical nightmare........

By all means buy the restricted version though, its your money.

I would just much prefer having the NR version myself.
