Hey i noticed today that the type97 is available for preorder on Canada Ammo. is it legal again or did they just leave the listing up for now just in case it does change back to non-restricted?

i would like to know cause thats one of the rifles on my must have list.

They did lose. They kept pan handling for the "defense" for a long time after they lost. For some reason that ugly rifle is still listed on their site.

I believe there's two cases; one was for the first version (restricted) - lost. The second is for the second version (non-restricted) - pending.

I don't think so but it doesn't matter. The difference between restricted and non was barrel length. The gun was found to be prohibited based on the FACT that it is easily converted to auto. So, it wouldn't matter how long the barrel is.
Have a read of the case. It's floating around on the Internet. Canada ammo's defense was a joke... They might have had a chance if they had spent the cash to get a lawyer.TWK

I have read the case, and it was quite apparent that the restricted version being defended could be quickly converted to full auto with minimal effort. Game, set... match. From what CanAm has indicated, though - the non-restricted version is a different design. This case apparently was still before the courts, but I haven't heard anything in a while (and in any event, I'm not in-the-loop).

Our case has not seen a courtroom.

The "lost" case we were raising money for was a reference hearing for a CGN member.

It was sponsored by the NFA; we still raise money for their legal defense fund with T-shirt sales.

Always a good idea to go to the source, not the rumour mill, for info.

No idea when our case will see court. These things take years.

PS We have not asked, nor received, any money for our case.

Either way, new T97 are being developed to meet the minders new rules.

Thanks for the clarification. I'm sure we all hope this case goes to court sooner rather than later, and with the appropriately favourable results.

And I will certainly be one of those anxious to purchase the newer version in the works... :)

I'll definitely be in line for a Canada-legal Type-97. Incidentally, the Black Rifle community owes Chris @ CanadaAmmo a debt of gratitude, as he stepped up in a big way to help fund the NFA's challenge of the RCMP's heavy-handed reclassification of the firearm in question. Without his support the challenge simply wouldn't have been possible without the NFA having to reprioritize other important projects. While the outcome wasn't what we would've hoped, it was a battle that was still worth fighting and should've been fought given the actions and attitudes of the RCMP involved in the reclassification process and later test case.
