BD38 Reclassified! Now Prohibited!

What does Garry Breitkreuz, MP for Yorkton-Melville, and the NFA have to say regarding the matter?

Letter sent to my MP:

"Dear MP Leon Benoit

I was shocked to hear that one of my restricted firearms (SSD BD38) status' had been changed from Restricted (Semi-Auto) to Prohibited (Full-Auto). I have legally owned this newly produced firearm for at least 4+ years (the firearm is a modern semi-auto replica of a very historical/rare/collectible firearm).

Due to age discrimination, I cannot hold a Prohibited licence, however I do hold a current Non-Restricted and Restricted licence and a "collectors permit". I have legally owned this firearm for 4+ years, I am a law abiding citizen and the RCMP have inspected my residence for proper storage in order to obtain my "collectors permit.

I will be outraged if this legally purchased and owned property is confiscated due the "Registration of Firearms" as it would re-enforce the fears that law-abiding citizens have toward firearm registries.

These firearms have been in the country for 6+ years, I know of no documented cases where this particular firearm has been used in a crime.

As a result, I hope that "Grandfather" status is granted to legal owners vs confiscation. This would be the only fair compromise in such a decision and would be the only way to treat property owners/law abiding citizens in a fair and democratic manner.

My Justice of the Peace, stated that my options are to seek legal adivice, wait for a warrant, donate to a museum (get a tax receipt) or consign/sell to a dealer. He also said that I should warn family members to ensure that the house is secure at all times (doors/windows locked - proper storage), ensure that family members do not have access to 'safe storage' and unless the RCMP are at the door with a warrant; family members should not allow access to the residence and should request the RCMP to contact your person.
 
You had better consider that since you are not in the prohibited class, turning in just the receiver, could lead to charges of being in possession of prohibited parts. I have been caught in this same "trap" before. I spent the money for justice and won, but it was an economic loss!!! Justice will cost more than the gun is worth and you could lose. Firearms owners are not financially supportive when it comes to firearms court cases. 99% of the people won't get involved in anyway to make change because it could cost them money to make a difference.

they will NOT let you turn in the reciever ONLY perhaps if it was registered as reciever only you could but they are not and you cant change it now....

Im sorry, but anyone who claims to have fought it out in court yet believes in the existence of "prohibited parts" kinda sets my BS meter to stand by mode.

Yes i wonder, exactly what parts would be prohibited on the BD38 or MP38 ? From what i can gather i can buy individual parts for machine guns off Marstar anytime.

Beyond un-pinned mags, theres No such thing.

There are a few prescribed prohibited devices, like the AR15 drop in auto sear, or the short barrels that Claven mentions. However, in the case of these guns, if the RCMP look at the original importation of these "fully automatic" guns as being improper, then all of the shipment, parts, and even magazines and accessories could be seized, even if they have since changed hands several times.

I did not mean full auto parts, such as sears or full auto bolts. More like barrels, firing pins, safety levers, example many of the 1919A4 parts they sell i can buy.

Stencollector is correct. I have always been asked to supply copies of my "applicable 12.x endorsed" license whenever I tried to purchase parts/accessories for the BD44, BD38, TNW MG34, etc... (not including mag pouches and the like).

I know that they now sell pinned MP40 and StG44 mags, but a few years ago, they did not...

Things may have changed?

(I, in no way, speak on behalf of Marstar, nor do I suppose to be correct in any aspects to info I have stated about what I think Marstar does in respect to "MachineGun" parts...) ;)

Sorry, I guess when you said "parts for machine guns off Marstar" I thought you were talking about machine guns as defined by:
An automatic gun that fires bullets in rapid succession for as long as the trigger is pressed.
I didn't realize you were talking about some other kind of machine gun.

Words I rarely hear my wife say......I think it would kill her to say it.

But back to Marstar, I somehow doubt they would risk a very long standing and valuable business selling parts for prohibited guns to just anybody who mailed him money, despite what any of the armchair internet lawyers say.

Anyway, this thread is getting very long and starting to meander. Until the CSSA has a chance to talk with the minister, and perhaps give him some input to the whole situation, I believe all else is conjecture.
