ok so I just shipped the rifle back to the dealer, we'll see what happens in a few days - a week.. this is their initial response to my original email, also below:
It should not be a problem with the rifle, it should not even affect accuracy as it is back by the gas port.. It looks like the hole for the gas tube was drilled a bit to deep and it went through to the bore (there were a handful of these with that). If the gun is still in good condition (no Marks or wear) with the orignal box we would be able to swap guns.

- a full refund
- a partial refund (I will sell the rifle disclosing the flaw...) this is not ideal
I've always had good customer service from you and I hope you can follow through for me this time, because this is the only time that something had been wrong with the product!
