This is not really "new"...

if the Alberta dealer ships the item to your home in Ontario then it's considered an Ontario sale and you will be charged 13% HST.

If the vendor fails to collect the proper rate of tax then they themselves will be liable for that money when they get audited by the tax department.

From what I undersatnd... there are no "tax treaties" between Alberta and other provinces.

I have been told specifically by my MLA that I do not have to concern myself with HST as we are not a participant.

So you haven't been collecting HST on all of your sales to Nova Scotia, New Brunswick, or Newfoundland and Labrador the past couple of years? Boy are you in for a shock the next time the CRA does a GST audit on your books.

There is no provincial tax treaty between provinces so one province never had to collect PST on sales to other provinces BUT there has always been a requirement for GST registrants to collect HST on sales to HST provinces... that's always been the case.

If you are a GST registrant and collect GST on your sales in Alberta (as required by law) then you are also required to collect HST on any sales made to customers located in what CRA calls "Participating Provinces". Up until July 1st there were 3 participating provinces (Nova Scotia, New Brunswick, and Newfoundland / Labrador) and they used an HST rate of 13%. Come July 1st BC and Ontario join the list of participating provinces and the rates of HST change depending on the province... BC will be 12%... Ontario, New Brunswick, Newfoundland and Labrador are 13%... and Nova Scotia is increasing to 15% as of July 1st.

The HST is lumped in with your GST collections and remitted as part of the GST remitance form.
