I can however, give the rationalization and explanation of the manner in which the law is applied to devices such as cartridge magazines and the SFSS interpretation of the Regulations appended to the Criminal Code as they apply to these devices.

QUESTION GENERAL

I am familiar with the regs that state you are allowed to use Pistol mags with 10 round capacity in a rifle if they happen to fit and are designed for pistols only (see item 4);

AR family restricted rifle users have been using pistol mags and enjoying the use of legal 10 round capacity in .223 and 7.26x39. Here is an example of a retailer selling the magazine product that I would be interested in for this project.

There is a magwell adapter for the Simonov SKS rifle that allows fitting AR magazines into the SKS. The only issue is that you have to shave off the ridge on the back half an inch to allow for the bolt hold open feature to work. Also there is some needed removal of some of the front lips to allow clearance to the loading ramp.
SPECIFIC QUESTION
The big question I would like to know before I run off and buy this product is;
Is removing some metal from the rear and front lip of the pistol magazine to allow fitment to the magwell adapter going to change the magazine into a prohibited device? Keep in mind that the modifications do not change the ability of the magazine to hold more rounds than before.
ANSWER
When it becomes necessary to adjust the cartridge magazine to fit and function in the firearm in which you intend to use the cartridge magazine; you have in effect lost the exclusivity of design and remanufactured the cartridge magazine for a use beyond that which it was “designed and/or manufactured”. In which case the cartridge magazine is no longer exclusively designed or manufactured for use with a handgun. In such cases it is no longer a handgun cartridge magazine and must be reduced to a capacity of not more than five cartridges of the kind or type for which it was manufactured.
It has been almost seventeen years since the coming into force of the Firearms Act and the Regulations appended to the Criminal Code are in need of a review and a rewrite. Most of the firearms and devices which present challenges today were not in existence twenty years ago.
