What would he had done if he shot an actual deer, then realized upon walking up on it that it was illegal (the whole 4" / 5" thing).

Would he have left it?
Reported himself?
Taken the chance of transporting it - hoping for the best?

Even these surrogate programs catch decent people.

if he shot a real deer and it was over 4" he would take a chance and go get a tag for his driver befor he moved it ,(town is 30 min away to buy deer tag)

yes i know , but i would think it would be better then not takeing it ...

and if you did something like that , thinking it was under 4" and it was 4.5-5" and you called the ranger and told them it was 1" biger i dont think they would fine you (unless the ranger is an ass) seeing you called it in

Better yet is to not shoot any game unless you are sure that you have the correct tag.

Why have a size limit if you aren't going to enforce it?If the antler length is too close to be sure,don't shoot.
 
I still don't understand the part of this story about gutting it.

From what I understand from the posts...
The gutting didn't actually happen; it was just part of the backup plan. If the deer was too big, his dad would've gutted it while the driver went to town to buy a tag. As mentioned already, still illegal. In BC you'd get a big fine for that no doubt.
It makes you think, if they had to make a backup plan, they must've known it was illegal or at least borderline.
 
Thanks. On the subject of shooting from a road, I believe our Manitoba regs say its prohibited from "maintained roads", and that includes a generous allowance for the ditch as well. Some roads aren't maintained, like road allowances across farm fields for instance. You can hunt on them. Certainly not from a vehicle, that's for sure. Me, I'm just staying the hell away from guns and roads. I don't need to get involved in that kind of crap over shooting a deer.
 
I've heard lots about this runnin' to town for a tag or go fetch jethro'...he's got a unfilled tag. This is the way in rural Manitoba.... I'm from the city (Winnipeg) and have all my sh*t in order before I go out in the morning.

The term is for shooting from a road is a provincial highway or built up road. Logging road is okay to draw up on a deer as long as you are out of your truck.
They purposely put "Fluffy" out on private land approx. 200 yards from the road and have already cleared with the land owner and verified that there is no people hunting or with permission to be there in pursuit of deer. You have to be 100 yards from the road and have permission from the landowner before you take the shot. Trust me....If you get a ticket for shooting "Fluffy"...they have you.....They leave nothing to chance. So there's alot of this story just doesn't add up.

I rolled up on fluffy in Ashern once and when I glassed it I knew. I purposely got out of the truck and stood there looking at it. I was surprised to find my self inundated with CO'S telling me to move on.... I guess I pissed them off I didn't take the shot ...

I hate lazy ass road hunters........Get out of your vehicles and actually enjoy the wilderness.
 
I'm not going to comment on MAN regs as I haven't a clue about them, but... DAMN. I mean really "up to 4inches" in my book means doe with a margin of CYA in case it's a spiker in the bush. And this whole "his driver to go to town to buy a tag" is BS. Spend the extra thirty bucks or what ever and have tags on hand for what ever you think you might shoot, or only shoot what you have tags for. And what, he lost his drivers license too? I've never seen fluffy, but I seriously doubt that they make marginal robotic deer just to make their jobs harder and more difficult to convict on. After all CO's just love going to court. More likely a five pointer than a five incher. Face it he got caught poaching and IMO didn't get slapped hard enough.
 
Puting "fluffy" along a well travelled road allowance on crown land during rifle season is bordering on entrapment I feel. Poor enforcement policy as too much gray area there... unless a guy's dumb enough to shoot from the vehicle. Might as well put a bag of cash there as well and charge the first person who picks it up with possetion of stolen property.

But if the guy in question did not have a proper tag or neglected to notch it then this person is just plain stupid... actually this whole crew sounds as though they fell out of the stupid tree...and hit every branch on the way down...

Given the amount of apparent POACHING in the area, I would suggest they need more fluffies and should be taking rifles, vehicles and hunting privilages. Maybe then some of these clowns would learn to hunt instead of poach.

i got lots of tickets like this one for doing stuff i should not of done befor and they are ez to fight , like i had a no helment ticket well rideing atv's offroad and i got away with out paying it , also got a ticket from the ranger for haveing fullauto gun's when hunting and got away not paying that saying all i was doing is hiting the triger real fast , and i did not have to pay it
