It is the designation of the chamber size under the FRT number that will give you capacity. An example is the Versa Max Tactical vs Sportsman vs Synthetic. They all use the same receiver which is designed for 3 1/2" shells. The barrels on the Sportsman and Synthetic are marked 3 1/2". The barrel on the Tactical is marked 3" and the designation under the FRT number is 3". Therefore the maximum capacity is different. More than likely the only time this would come into play was if you were in a court of law and the documentation was produced. But I would hazard a guess that you have bigger problems then that if they are checking your guns that close!
Got an actual, legal reference for that re the barrel markings? What if you put a VMT barrel on an regular VM? Or a 3.5" VM barrel on a VMT?
Remember, the FRT is a database. It's not law. And it contains entries for OEM guns, not modded ones.
ALL VM receivers are designed for 3.5", therefore all mags attached to them are for 3.5". My VMT owners manual says plainly that all VMs are chambered for 3.5" shells.
I don't see how barrel markings change anything.
Edit: Or how about this: I take a magazine tube off a 3.5" VM Sportsman and install it on a VMT. Since the magazine is the part referenced in law, not the gun it's a attached to, I clearly now have a mag on my VMT that can accept 5 rounds of 3.5".
