This thread needs to be circulated as much as possible.

As gun owners our way to fight back is effectively to swamp the legal system with appeals to the point where it's unsustainable and they're forced to toss the cases out due to lacking the judges to review each case. There are 2+ million of us and we can all appeal 1 time per firearm affected. That's easily 10+ for some of us with a minimum 30 days each.

On the same note those of us affected by this ban who work in the firearms industry should apply for CERB to the max limit possible.

FOr now, join a gun organization of your choice and make a donation to help fill their legal fund.

IF and when the government gets around to revoking all of the registration certificates for the affected registered firearms, know that YOU are the one who will need to fight this. No one can do it for you. This is YOUR cause, and YOU have a right to fight it in court. Saving these firearms for future generations to own legally will be based on each and every single gun owner being willing to exercise their legal rights to over turn this prohibitions.

So based on the OIC am I to understand a Bushmaster ACR is not affected by this?

I am surprised that the ACR wasn't already prohibited as a variant of several prohibited firearms, but for the time being yes it looks like it is safe.
 
Here's a question for anyone who might know. What happens when an OIC is made to prohibit or ban a firearm that doesn't have a registration certificate, I.e. the Vz58 or the Ruger Mini 14, as they are classified non-restricted? Apologies if this has already been asked and answered.

They *were* non-restricted, and now they're prohibited. But they don't know who has them so it's on the honor system to turn them in or export them or get them deactivated or grandfathered, otherwise you're in possession of a prohibited device.

Unfortunately newcomer, you're in the same $hitty situation as the rest of us.

We have two years less a day for the bureaucracy and the technical authority to figure out how to do what their bosses announced. This is unfortunately how government in Canada works, especially when the feds have to get 10 provinces and 3 territories on the same page. Your guns are safe right now. Don't freak out. But, read up on what CameronSS has posted about judicial reviews. It is in the Firearms Act. It is your natural justice right to be heard, even if the result will be a rubber stamp. I think the least difficult course of action will be to make a cost-recovery decision when the rates for compensation are announced. If so, just buy more guns that are different.
 
If they reclassify those on the list to prohibited, do they even revoke the certificates? If not, this appeal process will not apply. Almost like they planned it that way.....probably after seeing this post months ago.
 
Does anyone know if an order in council can be rescinded with another order in council? I feel like this specific topic was covered in a previous thread, but I can't seem to remember the specifics of that thread and also where to find this thread. Can anyone shed some light on this?

Yes, it can be repealed, it has done been done as least as recently as 2-3 years ago for some obscure reference in the Trademarks Act.
And since it would be repealing an existing order and not making a new order I can't imagine the "guns can't move down in status via OIC rule" applies because it's not an OIC directly doing the moving.

Section 74 talks about registrations, certificates, and licenses. If none of these are involved it doesn't look applicable.
 
Things suck, but lets not get carried away. My father joined the Royal Navy at 16 and a half to fight the Nazis after the house across the road was bombed, now that was unglued. We still have means to fight this and we should.
