K guys more progress. I think the messages worked. He know is trying to be civil about it. Guess the next message will determine my next move. I've told him there is no way I'm sending it back without a guarantee but that I do want this resolved too.

What the F are you talking about.
Escalate the claim and (FRAUD ALERT) will ask you to ship it back (while holding your money) and they will monitor the tracking number and refund you as soon as it shows delivered.
You dont need to trust him or anything.. why are you still talking to him... jeez thats so simple.
If you are past the 45 days delay well, its now your problem and you should assume your mistake. If not get your money via (FRAUD ALERT) and not by trying to convince him.

Got my wires crossed there Rick. Its in claims and will remain there. It was under the 45 days when it went to claims so things are tied up now with (FRAUD ALERT). He's trying to convince me to drop the claim but I told him I cannot do that because there is no guarantee for me. That is what I meant. So I explained the only way I'd cancel the claim was if I got my nice stock I payed for.
I guess what I am trying to say is I'm hoping he's learning his lesson and that the change in his tone maybe shows that? Dec 28 is the due date on the claim so we will see then I guess.

For sure. One way or another it will iron out.
He will just change his Ebay name and continue on. Those guys never quit. Some have been banned from 10 or 15 sites but still come back with another name, address and ISP. It is a con game and they are masters. How many did not complain and got shafted???

I'd imagine lots have. Only a few gave negatives for what they received, and I have no idea if the others went after what was rightfully theirs. But thanks to all of you guys I did, and I won! (FRAUD ALERT) just emailed me. I get a full refund from him, including shipping. Thanks a bunch to all of you who have helped so much with this! Happy guy here!

Another update. (FRAUD ALERT) says that its resolved and he has received his junk back but this guys till wont quit. Says hes filed a counter dispute because I 'never sent the stock back' even though it was sent expedited insured with signature required upon receiving it. Can he do this after (FRAUD ALERT) says its over? (FRAUD ALERT) says the money will be returned to me in 5 days in an email.

I think (FRAUD ALERT) will side with you. Perhaps some photos of it being packaged up would have helped. As well, the weight of the parcel will tell the tale....the butt stock is pretty heavy. If the parcel weighs the same going back as it did coming to you, he will have a hard time explaining the 2 or 3 pounds not being missing on the return trip. Hopefully you used similar or the same packaging. The weight of the parcel should be on your receipt form Canada Post.

I don't know what he's trying to pull. I used a bit smallert box but did a way better job packaging, used lots of foam, bubble wrap, plastic wrap and even a cardboard sheath for the fore end so if anything it weighs more than what I received. Also no notification from ebay or (FRAUD ALERT) of any type of dispute coming my way. I pulled my returned money out of (FRAUD ALERT) anyway just to be sure.

Yup that's what I'm at. (FRAUD ALERT) would not have credited my money back had he not signed for it.
Well, be lucky that you received the stock in the first place, then got credit. I'm stuck now by a stock for a No.4 rifle that got confiscated by Homeland Security! Never again will I try to buy from the US, these dozeholes don't have a clue about any reasonable or common sense transactions, appears like they are indifferent to any logic.
