Borrowing a friend's restricted firearm questions.

I wouldn't borrow a restricted gun...wouldn't it be better to just ask your friend if you could accompany him (her) to the range for a shooting outing together....and you could try out the gun in his presence....safer than trying to guess what the law is regarding borrowing it and landing you both in trouble....

Here's a novel idea CNEPACE.
Read your ATT conditions (on the piece of paper your licence came on) and see what it says.
If you threw it out call the CFO

Lol. I bet a few things changed since i received that paper a decade ago. And what good is a forum if we just called the cfo for every question ;) it would make this place boring.
 
Called and spoke to the cfo. You must call and get a temp att to borrow a handgun and it is only good for a set time which can be negotiated on the phone. This att can be received by email with no wait times.

(a) the person

(i) has reasonable grounds to believe that the borrower holds a licence authorizing the borrower to possess that kind of firearm, and

(ii) in the case of a prohibited firearm or a restricted firearm, lends the registration certificate for it to the borrower; or

(b) the borrower uses the firearm under the direct and immediate supervision of the person in the same manner in which the person may lawfully use it.

It is the last sentence that causes an issue. "for which he holds registration certificates"; different name on the certificate.

I inquired with the CFO about loaning a gun to a friend, and experienced hand gun enthusiast, who wanted to try it out before buying it. I was told a flat. NO. Not unless I went with the gun. Two problems; registration is not in his name, and my registered restricted firearm is no longer in my control. That document is misleading to say the least; it is not a legal document, and who ever wrote it certainly did not have the document reviewed by those in authority or the language in the document would not be gender specific. Have an accident on the way too or from the range; I suspect both you and the owner would both be charged.

Yes , you're reading it wrong ! As Tiriaq has already pointed out, read what YOUR ATT conditions are and go from there. Unfortunately, in Ontario, mine (and most others) reads "valid for firearms registered to the holder" so friends guns require another ATT.

Yes, and the CFO refused to issue me one under these circumstances.

Your firearms officer can issue an ATT that will authorize it.

It is possible that the CFO was unaware when I inquired; it sure looks like it is OK to do so here. Frustrating.

Old thread I know, but how many of us don't really know what the rules are about lending/borrowing amymore?!

The answer to that question would be "everyone that works for the CFO".
 
The wording of ATT's changed years ago. It was never a prob borrowing a restricted as long as you had the registration slip for it too.

Now I'm not sure if the "registered to you" part of an ATT is law, or just a CFO suggestion?
