I haven't read the proposed act since it first came out, but I think you've homed in on the pertinent section. Keep in mind though that all of this is subject to change as the act has yet to be ratified and it was supposed to come into effect last December. I contacted NRCan around that time and they had no idea when it would be ratified. While trying to find the link to the new regs for you, I happened to come across some info on how they're spending the month of May 2013 consulting with industry WRT the proposed act. I have a feeling we're still a ways away from this being enacted.
