Folding Stocks legality

I keep seeing all these pistol grip and folding stock shotties - do these affect the legality of the gun in any way?

Could you take this duck hunting?

How would the folding stock affect accuracy if you were, say shooting clays?

.. I dare say you could. But why would you want to? The folding stocks are fine for getting in and out of a car,and they do look "macho", but as far as actually shooting more than a couple of rounds from the hip, you're far better off with the non-folding versions ! From experience, I always preferred the original stock, with sling swivels added, carried muzzle down, left side, with left hand on the slide. Very quick into action and a safe form of carry ! ... Remember that the folding or colapsible stocks are legal but overall length(26") still applies to the shortest form of the gun when it is operable.

If you have a 12.5" barrel and a folder, and it's under 26" total length, is it a prohib or restricted? I've looked all through these forums and get mixed messages...

If you took the gun pictured duck hunting you would also need to have a plug in the magazine to limit the gun to two cartridges in the mag.

According to the Criminal Code, a restricted firearm is:

a handgun that is not a prohibited firearm;
a semi-automatic, centre-fire rifle or shotgun with a barrel length less than 470 mm (18.5 inches) that is not prohibited;
a rifle or shotgun that can fire when its overall length is reduced by folding, telescoping or some other means to less than 660 mm (26 inches);
any firearm prescribed as restricted (including some long guns).

The Criminal Code defines the following firearms as prohibited:

automatics, including those that have been converted so that they can only fire one projectile when the trigger is squeezed;
handguns with a barrel length of 105 mm (4.1 inches) or less, and handguns that discharge .25 or .32 calibre ammunition, except for a few specific models used in International Shooting Union competitions;.
rifles and shotguns that have been altered so that their barrel length is less than 457 mm (about 18 inches) or their overall length is less than 660 mm (about 26 inches); or
any firearm prescribed as prohibited – These can be found in the fact sheet listing restricted and prohibited firearms.

so basically, if the barrel was manufactured as under 18" you are non-restricted so long as the overall length is less than 26". If it's less than 26", it's restricted unless the stock of barrel have been altered AFTER manufacture to be shorter, then it's prohib.

clear as mud, right?

Thanks for all the replies.

I guess I was wondering what the purpose of such a device is, if it's not really a practical gun.

Take it trap shooting first...with the cylinder bore and other issues you may change your mind on a duck hunt with it. :D

Just clarifying.

What I find so strange is that if a person changes or shortens the barrel it can put it in the restricted class, but if it comes from the factory that way, it's OK.
This raises the question of which factory shotguns are shipped from the factory as restricted. SO what is the shortest "stock" shotgun

I assume you mean "What is the shortest non-restricted "stock" shotgun, right? If so, it would be the Norinco HP9-1 or the Remington 870 Police 14" shotgun or the Remington 870 Special Purpose 12.5" breeching shotgun with a full fixed stock.

Of course, only the Norinco is inexpensive and easy to get. ;)

Not quite. If YOU shorten a barrel to less than 18", it becomes PROHIBITED, not restricted! If it's a semi-auto, the shortest you can get is 18.1" I believe. For instance, a regular Rem1100 with a 20" barrel is non-restricted, and the 'tactical model' with a factory 18" barrel is restricted. Make sense? ;)

The shortest 'non-restricted' firearm you can get is one that has an overall length of >26". An 870 with one of the FACTORY Dlask 12" barrels will probably be pretty darn close to that.

EDIT: Dang it Claven... you're too fast! :)

SO lets go all or nothing here. What is the shortest semi-auto restricted that is legal to purchase. All my shotties are full size wood stock and weigh a fricken ton. Next time I buy a synthetic stock as my back kills me every fall.

Shortest semi auto RESTRICTED? There is no length restriction. Any length would be legal to purchase if it's restricted.

But, you'd only be able to shoot it at a range, so buying one for hunting would be a waste (since you couldn't use it!).

For semi-auto, it's 470mm. That is 18.504", so if you cut to 18.1 you're breaking the law.

For non-semi-autos (ie, pumps, levers, etc.) it's 18 inches or 454mm.

Hmmmmm...... Strange question for a firearms enthusiast to ask.... unusual screen name... very new member.....

*EDIT*
But then again, maybe I'm just paranoid these days...
