I had one question that has puzzled me, if someone comes into your house with a weapon i.e. gun or knife can you use a restricted firearm like a glock, to seize the person if you follow the criminal code of self defense or would it be a charge? How could you avoid any charges.

Just wondering, better safe then sorry eh?

I believe that so long as you had the restricted legally stored and the intruder had a firearm you are allowed to use deadly force to protect yourself. Not sure if the person only had a knife.
 
technically they can still get you for loading and discharging a restricted firearm outside of an approved range. whether or not i give a #### about that when something is about to go down in my house is something i will decide upon when that time comes, and hopefully it never will.

Just of it, 2 guys break-in & go into bedroom when the couple are in bed. Dude gets outta bed, takes a knife from 1 robber & kills him and wounds the other robber (who eventually gets away)...


Basically, you can only use "justifyable force" to defend yourself & home from invasion. But you'll be scrutinized under a microscope by everyone thanx to the media & Police...
 
The only way to absolutely avoid getting charged is to be a victim. Any action you take with a firearm may get you charged. You have to decide if its worth it, and you have to take the chance that it is justifiable. There is a defence of necessity, but it likely has a pretty high standard of circumstances. Safe, legal but readily accessable storage would be your best bet in my opinion. A digital safe, slide locked open, full mag on standby.

Everything you post on the internet can be found and used against you. don't ever think the Crown would not use such a statment in their case against you, no matter how justified you were in the action.
 
I would also suggest a seriously impenetrable door on a safe room in which you can retreat and retrieve the firearm would be a good idea. Even better if that is your bedroom so you are buying yourself time.
 
how many bad guys armed with a knife were shot by cops. I think a good court challenge would be why can't a citizen use deadly force to defend against bad guys but a police officer can ?
 
It might sound harsh but, shoot to kill don't maim them. If they are dead then there is only one side of the story.

Personally I have a 870 legally stored in my bedroom, the fact that it is non restricted is just one less thing for the crown. I hope that it will never be needed. I would rather it sit there collecting dust and never be used, than need it and not have access to it.
 
I remember some cops I used to know many years ago talking about this
exact thing. If you only injure the intruder-then there are 2 stories to deal
with and if he is the only one hurt-guess which way it will go for you here
under Canadian law. Second-dont shoot em in the back because then they
were trying to get away from you and no longer a threat. Either way you
would get charged with something and most up ending up being the "bad guy" in the whole thing.

I hear you guys when you say the story would be straight but look at the law:
34. (1) Every one who is unlawfully assaulted without having provoked the assault is justified in repelling force by force if the force he uses is not intended to cause death or grievous bodily harm and is no more than is necessary to enable him to defend himself.
 
I got my handgun in a safe on my nightstand.... It get unlocked every night...

I wont think twice about sending someone 6ft under if they enter my house at night...

I will deal with the rest after... My Kids come first... and PTSD comes 2nd ...
