9. (1) A police officer, or the occupier of premises, or a person authorized by the occupier may arrest without warrant any person he or she believes on reasonable and probable grounds to be on the premises in contravention of section 2. R.S.O. 1990, c. T.21, s. 9 (1).

Would this be considered "pre meditated" ?
Sounds good on paper but very impractical in real life. Years ago I was hunting a property that I had permission for, with my uncle. The old guy took a wrong turn and ended up in the neighbour's property making his way to my car so we can leave. Neighbour -who was also an older guy- confronted my uncle and started screaming and cussing at him, they were a coupe of hundred yards away from me but I could see them clearly from the road. Next thing I see is the farmer trying to wrestle my uncle's loaded Baikal SXS away from him! Farmer had the muzzle gripped close to his stomach and uncle was pulling the gun away from the grip and stock. This lasted for a good ten seconds, all the while the hairs on the back of my neck were standing up, I truly expected a tragedy to take place. Thankfully the gun did not go off and the uncle managed to overpower the guy and take his gun back.

Private property will be the end to hunting and most people don't realize this. Before communism in former Czechoslovakia, everything was privately owned and it was hard to be able to hunt lawfully. The land owners, and the friends of the land owners, where usually the only people who could hunt. Imagine a country where only the rich could hunt. Then the commies came and took all the private land away and made it like are equivalent for crown land. Hunting became much easier to participate in. You could hunt on the crown land without permission that was with in your hunting clubs permitted area. Kind of like are hunting regions here in British Columbia only you could only hunt in the regions that you were a member of. Once nothing is crown land anymore, either native or private, everyone will need permission to hunt. The queen is generous to allow us to use her land as we please. If I owned private land, I would be "that guy" that is pro hunting. I would post signs that says, "Private property, hunting permitted, be weary of inhabited buildings to the ____ at _____ distance. Donate some of the meat if you get something" It is you're land, and you may do as you please, but that is what I would do.
Not trying to sound cynical, but there are a lot more arseholes in the hunting community than good folk. Owning rural property, will soon acquaint you with many of them over the years. A couple of my properties are posted, hunting by permission only. I have never refused anyone that asked to hunt on either place. Over the years I have had two instances of people claiming ownership of each piece of land, and chasing off people that were there to hunt with my permission. I have had gates destroyed, cables cut, signs ripped down, and garbage dumped. People don't realize that I am the one to clean up the crap these slobs leave behind, deal with the cutting of trees and trails cut through my land, pay the taxes, and are liable to a certain extent for these idiots. Sometimes it makes me want to sell out to one of the forestry companies, and let them clearcut it all and plant a monoculture forest to feed their mills. Then we all lose.
