I really need your help and input!

Is this a "named body of water", cuz if it is, you can't restrict access to it. There will be RM roads that go to the water, and if your gate is across one of them, you're lucky you still have a gate.

Ah-hah! We have a suspect......:p
 
Just a thought, but if you are going to go for a stroll down to your fishing hole, you might want to consider taking a friend or two with you. At least if anything gets out of hand and you find yourself in a scuffle your friends can provide testimony later on that you were only acting in self defense. I'm not suggesting you start a fight, however it will be much easier to prove that you didn't if you have three people telling the same story.

as far as i know, if you are on your own property and things get "out of hand", you the owner are deemed to be the assualted one automatically.

we have people that trespass on my Aunts farm. I stopped one fellow and he told me he had permission....about 10 years ago. I commented that he was not given life access to the property and should be checking in with the land owners. He started giving me grief telling me he was like family with them....until I mentioned....I was family and they could not even name the owners....

As mentioned before, some people have no ethics or morals to speak of. Passive warning is unlikely to work on the fellow as he believe he has the right to access it. He behaviour will likely unchanged until you can directly confront them/him.

On a technicalogical point of view, there are two types of trail cameras that directly upload the pictures via cellular to a website so you can download them. Although expensive, you could gain enough evidence to at least have the LE types have a chat. As noted, you do risk the chance of it being stolen but if you position it right, you will have some good pictures to see the police about...

For the people who spout about what would be "admissable in court": in Canada, it is legal to tape any telephone conversation if either of the parties is aware of it.

Any person in public has no expectation of privacy. Those that bleat about cameras are trying to create an expectation of anonymity, which just does not exist. If you are in public view, you cannot complain about being recorded.

Nope. There are no other ways into this lake, BUT there is a boat launch just before my property line. But as I said before, the people are clearly tresspassing.

That can easily be beat to #### in a court of law "your honour I had my trail cameras set up in hopes of getting that "big bull, but I suprisingly caught a tresspasser" come on man...get with the program ;)

Ok here is what I am going to do this sunday.

Driving out there on the ATV's and going to put a "This area is under video surveillance" sign right on the middle of the gate backed by some wood.

Not going to put up a camera for now, going to see how things go. I am pretty sure given the fact that this sign, along with a no tresspassing sign they will phuck off.

Who would be so stupid to KNOW WE KNOW that they are tresspassing KNOWING we're looking to get their picture and have them charged.. something to think about. I think it is a smart move. And if this person keeps breaking the law after that. Then a camera is going up. My neighbour said he has two I could borrow.

Thanks for all the advice. I am a nice guy, pretty easy going but when you abuse and liter on my freakin land this nice, pretty easy going guy turns into satan himself "lol". Not to mention "AVOIDING THE SIGNS"

Ther's always the possibility, however remote, that the perp(s) might be on this board. Don't let out all the details of your plan just in case.

You would be correct had you wrote "both parties". If I know I'm recording our conversation it don't go to court unless I informed you.
