Incredible Stun Baton?

No #### ! Can they seize a baseball bat if they see me walking down the street with one going to practice !? Cause technically that falls under the weapons category.
That's why if the law asks if there's any weapons in the car you answer with NO but I have a utility blade in the glove box. If you answer and say ya there's a knife in the glove box, technically you said yes to the questions of "weapons" in the car

A box of steak knifes is an innocuous object less than 30cm specifically designed to conceal a knife. You could hide a freaking katana in a cane as long as it's longer than 30cm, but a small box for the steak knife you just bought at walmart? You're a criminal.

Modify a knife to make its handle perpendicular to the blade? It becomes a prohibited pushdagger.

Bear-repeallant? Fine! Call it pepper spray though, and it's a prohibited weapon.

Meanwhile, a 80lbs woman can go to a kennel and buy a 150lbs tibethan mastiff (which she would never, ever be able to control) and walk around a playground full of kids with it.

And that, my friend, is why we would actually need "Non Firearms Prohibited Weapons Expert" somewhere around when laws are written.

P.S. Your baseball bat is fine as far as I know, unless you have 2 of them and tie a rope or chain between them. Cause then that's a nunchaku, which is obviously dangerous.
 
ok. just reading the thread has given me the creeps as to what the cops can do with their interpretation for the law. just imagine what would happen if someone was actually to use it in a self defence situation....this is honestly quite terrifying, as you are technically not allowed to defend yourself unless you carry a body cam with you 24/7 to record exactly what happened so you can prove your innocence in court.....so here is a sort of off topic question....what are you legaly allowed to have to protect yourself from a threat? (if you had to knock someone out with your fists because they are a potential harm....do you get your hands cut off and confiscated? lol...well actually its no joking matter...).

A friend of mine that lives in Surrey came home early from work one day and found two men in his house stealing his property

Seeing as he was outnumbered he knocked the one guy out with a punch to the jaw and the other guy saw this and ran away.

When he phoned the cops they showed up and put him in handcuffs for using excessive force. He was in trouble for not just letting them leave the way they came in. They said that for someone of his size he should have just held them down. One guy had a big flat screwdriver and the other guy had a small crowbar and the cops wanted him to hold them or let them leave. But hitting the guy was asalt. He had to talk himself out why they should not be pressing charges against him and the whole time their supervisor was pressuring them and asking them why they do not press charges. It's a joke.

It's like they want to screw a guy who was protecting his stuff and also himself with criminal charges for the rest of his life. This guy has never been in trouble with the law an gets in a sitchuation like this and he is now the bad guy.

The law is there to screw anyone at anytime that is why they write it the way they do. Totally open to any inturpritation. Whatever suits the out come that works for how they feel at the time. If you don't like it go to court and spend all your money for a coin toss outcome. No Justus for the victims and sometimes a kick in their asses also.

A good ole push down the stairs once he was knocked out could have solved that. Idunno officer I opened my door , one guy ran out the back and I heard a huge thud , the second guy was laying at the bottom of the stairs!

First of, police can accuse you of anything they want. Doesn't mean it'll stick into a court of law. That's why we have due process in this country. Keep that in mind when you see on the news that someone has been accused of terrorism and will be punished without anything resembling a trial.

Second, this is the criminal side of justice. The civil side really is the same thing. You can sue anyone for damages for any reason. You don't like that my eyes are blue? You can sue me for damages. You're definitely gonna lose, and probably end up paying both of our lawyers, but you'll have your day in court.

What's both funny and tragic in this case is that the police corps that seized the stun baton is either completely incompetent or are acting in bad faith. It's obvious that a visit into a court would end up with a judge taking out a measuring tape, measuring the thing, and then shaming the cops for being too dumb to just measure the damn thing. The only way out for the cops would be to prove that it can be discharged when its length is less than 480mm (for example, if it can be separated into 2 parts but you can still discharge it when separated), which I guess isn't possible. The real problem is the cost of all that procedure, which is much much more than the 40$ this stun baton goes for.

The only leverage the OP has got is to file a deontology complain agaisnt the 2 officers: the one who seized the property and the alleged expert. That's very little leverage, considering that unless they get their asses kicked by a judge in a courtroom, they've done nothing wrong. Other than that, I guess sending a letter to the "expert" explaining that this damn baton is not prohibited, with a copy of the law, highlighting the "less than 480mm" with a pink marker is doable and would cost only a stamp. But that's betting on a cops being reasonnable and admitting that he's been wrong all along. You have better chance winning the lottery.

Simply ordering a new baton is the option I would personnaly choose. And also never spending a dime in abbotsford, I'd consider moving if I lived there. When cops resort to facism, it's time to get out of dodge.
 
I just heard from a friend that APD routinely pays cash to shut people up when their officers have stepped on their dicks like this and the person pursues it. (out of court settlement)

He also said that they do the same EVERY time a K9 unit takes someone down.

I doubt that this is 100% accurate. But it is certainly worth probing given APD's reputation.

That is what needs to be done to straighten this out. I would wish you good luck, but I feel you won't need it and things will be made right. Good to see you're not going to bend over and let them F you over. If they thought they had a case, I think they would have laid charges.

Do you have a go fund me page? I'd throw you some cash for your legal fees. We all need to stick together as a community against abuse of power by the police. Today it's his stun baton, tomorrow it might be your legally aquire firearms.
