I know they are prohibited, and require a 12(5) OIC #13.
I assume the can still be aquired by people with that classification.
Is that right?
Thanks.

FN FAL rifles could be 12(2), 12(3), or 12(5).
Yes, if a person has the appropriate endorsement on his PAL, he can acquire a rifle in that category.

Yes, you can acquire them, but without special permits, which the CFO's won't issue, you can't shoot them.

Completely phucking bogus IMHO.

Yup, they won't issue special permits to take them to the range now. You can only enjoy them in your safe, this is nothing but willful harassment.

Is the NFA and/or the CSSA doing anything to try and get this deliberately instituted harassment that has no basis on any law stopped?

The situation sucks, to be sure, and last year I acquired a British L1A1 I would love to try at the range. But sadly, not until things change.

However, it is false to call it harassment that "has no basis in law". The prohibition against transporting 12(x) prohibs is very much codified in law, and the bureaucrats have zero say in the matter.

I am totally unaware of the SAP denial being based on an existing law. Could you please point to a link where it is stated?

read below excert from the firearms act clearly stated purposes for prohib firearms in section 19-2

(a.1) to provide instructions in the use of firearms as part of a restricted firearms safety course that is approved by the federal Minister; or

(i) changes residence,

(ii) wishes to transport the firearm to a peace officer, firearms officer or chief firearms officer for registration or disposal in accordance with this Act or Part III of the Criminal Code,

SAPs were issued for prohibited long guns after C68 (the firearms act) became law, they just ceased issuing them as I remember. So there was no change in law or another OIC?

you are incorrect there was a change in law , specifically the addition of section 19-2 to the existing section 19-1 a+b and their subsections
irregardless of what happened in the past what the issue is today
is the requirement in law for the cfo to not issue a transport permit for the purpose of target shooting for any prohibs other than 12-6
secondary to this there is also a legal barrier to the discharge of full auto prohibs on any cfo range approved under section 29 of the act.

this is noteworthy as even if we had a legal amendment to the transport provisions the 12-2 grandfathered fals still could not be used for target practice.

I guess the issuance of a SAP permits post "firearms act" was not meant to be a certain approval. For instance a 12(2) could not be taken to just any range but only to military ranges but many were approved for 12(3) and 12(5) and certified as such.

So again, the CFOs were issuing SAPs post firearms act but all of a sudden at a later date decided to stop. Nothing appears to have changed in law but they just stopped issuing SAPs altogether, at least that is my understanding. Did they amend C68??

yes the law was ammended via the following

2003, c. 8 (Bill C-10A )
An Act to amend the Criminal Code (firearms) and the Firearms Act

this act states the following and i can provide a link to the document

16. (1) The portion of subsection 19(1) of the Act before paragraph (a) is replaced by the following:
Transporting and using prohibited firearms or restricted firearms

19. (1) An individual who holds a licence authorizing the individual to possess prohibited firearms or restricted firearms may be authorized to transport a particular prohibited firearm or restricted firearm between two or more specified places for any good and sufficient reason, including, without restricting the generality of the foregoing,
(2) Subsection 19(1) of the Act is amended by adding the following after paragraph (a):

(a.1) to provide instructions in the use of firearms as part of a restricted firearms safety course that is approved by the federal Minister;
(3) Subsection 19(2) of the Act is replaced by the following:

Exception for prohibited firearms other than prohibited handguns

(2) Notwithstanding subsection (1), an individual may not be authorized to transport a prohibited firearm, other than a handgun referred to in subsection 12(6.1), under that subsection, except for the purposes referred to in paragraph (1)(b).

Non-residents

(3) A non-resident may be authorized to transport a particular restricted firearm between specified places in accordance with sections 35 and 35.1.

Thanks for the explanation Bluestratus.

So we just have to work on getting a senseless law repealed ...

Why exactly is a 7.62 NATO semi-automatic rifle prohibited? Too easily convertible to automatic?

In 1994 ALL semi-automatic centrefire rifles on the market that came standard with a pistol grip were prohibited. ALL of them. The AR-15 was later granted an exemption. Any other designs you can buy now came on the market after the list was prepared.

And we need to have EACH AND EVERY ONE of those firearms removed from the "Prohibited" list. There is NO reason, other than the Lieberals hate firearms, for them to be out of the hands of law-abiding Canadian citizens.

Yeah, I know, preaching to the choir :D

The children are safer because those that do own any of those listed firearms can't take them to the range ...

And you know, when I got this list in the mail from Allan Rock's guys, the new (at the time) HK caseless ammunition rifle (the G-11) was also on the list; Even though it wasn't even for sale AND still in prototype form.

Their justification for including that on their "list"? To paraphrase, "because of these firearms association with crime". Funny how a rifle that's not even in production found it's way on the "frequently used in crime" list:mad::mad::rolleyes:[/I]
Of course, that whole argument was statistical B.S.....but there just wasn't anything we could say or do to stop them. Gun Control was the spirit of the time, and all the lemmings (general public) hopped aboard.
