unloaded, in respect of a firearm, means that any propellant, projectile or cartridge that can be discharged from the firearm is not contained in the breech or firing chamber of the firearm nor in the cartridge magazine attached to or inserted into the firearm.

So the cartridge isn't in the breech as that is on the barrel end of the PC carbine but if you have a magazine in the firearm receiver end maybe?

It looks like you have 2 conditional statements to have something be unloaded. Not in the breech and not in a magazine inserted in the firearm. Where even though you can't shoot the PC Carbine without the barrel you have the receiver part (which is legally the firearm) "loaded" with a magazine in the magwell. Which makes sense as an rifle with an empty breech but a filled magazine inserted is basically a loaded firearm.

Anyone else have a different interpretation?

My thinking was it isn't a firearm unless assembled but I wouldn't want to be the one to trying to find this out in front of a court.
 
A firearm receiver is a firearm legally speaking, so that isn't in contention.

firearm means a barrelled weapon from which any shot, bullet or other projectile can be discharged and that is capable of causing serious bodily injury or death to a person, and includes any frame or receiver of such a barrelled weapon and anything that can be adapted for use as a firearm; (arme à feu)

I think after stewing on it for a couple of hours my interpretation is correct. Legally speaking it isn't unloaded per the storage, display, transport regulations

Acording to that having the full mag in the butt stock also makes it loaded…. Assembled or not. As it does not specify inserted into a firing position.

It does not say “inserted in such a manor that cartridges can be fed into the breach / chamber”. Which would have been a better lawful definition of attached magizine.
 
If you run into the rcmp and they charge you for a loaded firearm because the buttstock had a magazine in it, it's probably the least of your problems.

ie: why the hell are you talking to the rcmp? Why are they there? What were you doing? ect. ect.
 
Is a stock a firearm though, is the exact wording to keep track of.

A magazine attached to, or inserted in a stock isn't in a firearm.

Would be an interesting question for firearms that have the upper receiver be the firearm like the SG540's or the gsg16.

Or consider the shotguns with match savers attached to it.

In any case it's a kludge of a law trying to define what unloaded is.
 
I got tired waiting for solid answer from when these might be in country again so I ordered one from opticsplanet in US. Shipped today and came out to $348. Would be less if I hadn't forgot to use CC for exchange rate instead of ######.
They still show stock of black so might be quickest way to get one right now.

Noticed that and ordered earlier tonight. Invoice they sent me now shows it listed as backordered, even though it was listed as in stock at the time of my order and still shows stock hours later. Just a heads up

Yep my invoice says Back ordered. ******update, called Brownells and they said it's actually in stock.
