Mossberg Tactical 25 round mag prohib?

Have you contacted Mossberg? Maybe they can say to the best of their knowledge that one way or another if their magazines can be used in any pistol. Then you could fwd to the CFC to support your arguement. Mossberg would have a vested interest if their magazines are all of a sudden prohibited due to a clerical error at the CFC.

Now on to the actual meat of my post:

The Mossberg Tactical 25 round mag is NOT prohibited. It is NOT designed to fit into any pistol, nor is it advertised as such. IF it happens to fit another firearm (pistol or rifle), it STILL doesn't matter. If it does fit some handgun, that doesn't change its classification, because it was not designed to be used in that pistol. The same reason why we can have 10 round LAR pistol magazines (that take .223), and use them in rifles. They coincidentally just happen to fit. That doesn't make it illegal to use them in a non-restricted RA XCR (hunting with them is a different story, but target shooting your fine). Why you may ask? Because, they were DESIGNED (I hope I am getting my point across) for a HANDGUN.

From the RCMP website (Special Bulletin for Businesses No. 72):
4. Magazines designed for one firearm but used in a different firearm

The maximum permitted capacity of a magazine is determined by the kind of firearm it is designed or manufactured for use in and not the kind of firearm it might actually be used in. As a consequence, the maximum permitted capacity remains the same regardless of which firearm it might be used in.

Example:
The Marlin model 45 (Camp Carbine) rifle chambered for 45 Auto caliber uses magazines designed and manufactured for the Colt 1911 handgun, therefore the seven round and eight round capacities are permitted. A similar example is the 10 round capacity magazine for the Rock River Arms LAR-15 pistol, regardless of the kind of firearm it is actually used in.

And if you keep demanding "proof" that it is legal, sorry son, in this country, you need to prove to us that it is ILLEGAL! Also, "Well, soandso from the CFC says BLABLABLA", doesn't cut it.

Words to live by. The Americans do the same thing writing letters to the ATF.
Please don't ask the CFO for legal opinions. They are not qualified to give a legal opinion on anything.
If you ask the CFO or a US manufacturer for legal advice you are too stupid to operate a drinking straw. To put it politely.
 
How is it trolling if it is written in the firearms refrence guide that prosecutors, police, RCMP all police forces for that matter use. Seems they may be mistaken in their guide but as we all know police charge first then let the courts decide. Yeah good point why ask the LAW makers and Law enforcers about law seems stupid to me. Oh wait nope I will ask you first yeah that makes sense! Duh! Obviously there is something missing here but that is what it is for now and until the time I get something in writing I will err on the side of caution.

Please, show us where that is "written", cause you haven't provided us with any "proof" of that statement, other then you talked to soandso at the CFC. Also, the CFC is neither law makers or law enforcers. They are bureaucrats. Pencil pushers. Doesn't get any simpler then that. You have been given some poor info by somebody at the CFC and are taking it as gospel. Even when you come here to ask us "Hey, whats up?", you don't even take our collected word for it and continue saying that what you heard MUST be true, because we can't show you were it IS legal. But I explained to you, the way our (Canada) law works, is the law says what is illegal, not what is legal. You won't find it in the firearms act saying "Using a Mossberg Tactical 25 round magazine IS legal". You will see what you are NOT permitted to do.

Take your time, call around to as many shops that carry the magazine in question and ask them if that is a prohibited device. THEY have a much better understanding of what is good, and what is a NoNo, then the anti-gun pencil pushing, paper stacking numbnuts working at the CFC. It is just a job to them, they probably don't even care if they gave you the wrong info on that magazine.

This pretty much sums it up.

Also Valencjo its odd that you come on here asking "hey whats up with...?" yet refuse to accept the answers given. Even when the answer is "call a dealer" or any number of them really cause they wouldn't risk their entire business selling prohibited stuff accidentally. The folks and the CFC are not experts they are call centre receptionists at best. They don't know the laws. Talk to a dealer who's entire life is vested upon knowing the laws surrounding the product they are selling.
 
That's what Valencjo doesn't seem to get...he talked to one person who obviously isn't an expert.
I deal with police (including RCMP) on a daily basis through my job.
They are the first to admit...THEY DON'T KNOW ALL THE LAWS Velencio...that's why we have courts and judges.
The police (or in this case whomever you spoke) are there to interpret the law to the best of their ability...they can be wrong.
This is obviously the case here...so take a deep breath and let it go.

Reopening this thread.
Mossberg does make a pistol which accepts the same magazine as the rifle-the Model 702 Plinkster.
Mossberg makes magazines that fit both.
Therefore, like the Ruger, the OEM magazines are intended for use in both the rifle and the pistol, and would therefore be limited to 10 roounds.
If dealers are selling 25 rounders, they better check their FRTs, contact the RCMP, and act accordingly.
 
I was at the range last weekend and was shooting one that belonged to the guy in the next lane.He had just bought it a week before and I shot 25 rounds without reloading. I am sure he never called for permission from CFO and I know I wouldn't, I trust the dealers I buy my guns from to also not want to go to jail.
Are some people at the point of paranoia that they double check everything with the "authorities"? Or is it the equivalent of poking sticks at a bee hive, waiting to see what happens?
 
Galt - I checked the FRT entry myself. The 25 round magazine blocked to 10 is noted.
Folks can do as they please, but if push comes to shove, the opinion of the police and the crown will be that the 25 rounder is a prohibited device.

And is the big plastic tactical mag the same as the plinkster?

This and a bolt action pistol never went into production, was just a concept thought...

This also refers to the reverse of max capacities regarding pistol mags..... it states that if a center fire mag pistol of 10 rounds which also fits a rifle it must be pinned to five rounds.

This is incorrect. You should not be giving this sort of advice as you apparently do not understand the issue or the memo.
