The ban on lead shot for waterfowl hunting was based on much higher concentrations of shooting, and thus lead shot, being present at waterfowl hunting locations. The concern was that waterfowl would pick up shot off the bottom of waterways as a byproduct of feeding. Upland game hunting is significantly different because it does not take place from fixed locations, This creates a situation where a hunter may discharge once or twice from a given position before having to move along to another position to locate more game. The dispersal of shot across the landscape results in significantly less shot being present in any given location. This decreases the likelihood that game birds will pick up shot as a part of their feeding, as upland game birds are visual feeders and will not pick up shot as it doesn't resemble their feed sources.
