Saved a young bucks life tonight!

i'm still fairly new to hunting (this is my first year) but what i have been hearing is that if the land is not posted "no hunting" "no trespassing" or something along those lines it is implied that you can hunt there.

i am not condoning him hunting after hours or from the truck, but i didn't see the OP mention it was posted land.

if i'm way off let me know

The law varies from province to province. In MB, if there is a fence line on private land, you need at least verbal permission to cross it. In MB, if you see land posted "No Hunting" that usually means the land owners has had issues in the past with idiots trespassing and being a problem.

Used to be that way before July 1, 2008 but no longer. You can and will be charged if you hunt my land without permission, strangely enough, if you bother to ask, you'll probably get permission...

ok so do you have any signs up that say "hunting with permision only" or any signs up at all? fence?

I have seen signs with "hunting by permision only" and had a phone number on the sign before.

Nope, don't have them and don't need them. If you don't know who owns the property you're hunting on you have no business being there. The RM office sells maps for $1 or $2...splurge or go play "big game hunter" at the local bar.

well i did some searching between everything i could find on google and reading the 2010 hunters guide there is nothing about

i did find that "regardless of how land is posted (ie: no hunting or no trespassing), persons may hunt on that land provided they have permission from the land owner or lessee"

so what i take from that is if there is no signs up it's open to hunt there, if you post it then they need your permission and if you have such a problem with people hunting it or you want to regulate how many or which hunters are there then maybe you should splurge and buy some signs.

it's your land and you can choose if you want people to hunt it, but without any signs up you should not be expecting no one to hunt on it. personally if i saw land with no fence, no signs, with decent deer in the field i would hunt it.

i do understand where your coming from my family has land in zone 40, we rent the land out and the lesser has it posted. This year i asked for permission to hunt it and i got the permision plus permision to hunt the land across the road that he owns......the difference being that he bothered to post it

The hunting guide does not contain all the legislation involved, it's a guide.
Personally, if I caught a hunter on my land without express permission, they would be before a judge...and they'd loose.
My mistake, the changes to trespassing laws came into effect June 30, 2009.
The ownus is now on the trespasser to get permission, not on the landowner to post signs.

CORRECTION:
I just read the Trespass to Property Act, and until you've been told to vacate, you are not trespassing (unless the land is posted or enclosed)
 
I personally hold that it's good practice to stay off private property, regardless of how it's marked. You never know if someone's out for a walk on their property, have a house in the stand of trees behind the deer you're aiming at, or just doesn't want you there.

Regardless of the strict lines of the law, when you're hunting you're an ambassador for all hunters. You piss someone off somehow, you've just made an enemy of the whole hunting community.

Well said H wally. I would never even think of going on land to walk little lone hunt withought land owners blessing. As for my property I go by this rule.
"If i catch you there you might be found there later" some people take offence as to my blunt no grey area , descriptive nature as to where they should go and how fast I think they should get there. Ive had too much stuff stolen to worry wether someone thinks I should have signs up to tell them they are tresspassing when they have no permission to be there.

I think it is up to the hunter to be responsible enough to know whether land is public or private,posted or not.There are enough places where maps are available,Basically most R.M. offices as well some crown land and WMA maps can be downloaded off a computer.
As stated before,before you go hunting on land you are unfamiliar with,do your homework to avoid an accident,tragedy or violation of the law.
 
After reading everyones rants on here have none of you guys ever checked out a buck with your rifle scope?I dont know if this guy was going to shoot or not but who on here has not looked through their scope to check out a deer,as far as saving a deers life how about get a life.

Really, do you honestly roll down your window stick out your gun and check out deer with rifle scope from within your truck/car?

The sad

part is the Manitoba Provincial Government has cut back the Conservation officers to almost extinction. There is NO ONE(okay almost no one) in southern Mb to patrol and check on the ODD hunter or to investigate complaints.

I almost feel vigilante justice coming on. I have NO USE for the REDNECK hunters.

The demise of the Big game will be at the hands of the law breaking hunters which there are MANY............

All b.s. and arguing aside is it illegal to look at a deer through a scope with an unloaded rifle if I am wrong I stand corrected.Christ I look at my horses through a scope if I dont have any binocs.Also what exactly is a redneck hunter someone that can out shoot you?
 
I don't think that the guy was just glassing a deer from his truck if he took off so fast when someone came along ,just because he forgot his binos. I may stand corrected.

If I happen to see a guy sitting in his truck looking at your horsies through his rifle scope I won't worry about it. Ill figure he just likes horsies and forgot his binos , back where he poached his last deer. LOL !
