It's a single action pistol and the hammer is down. Look the extractor, that chamber she be empty.

No matter how much finger you put on that trigger she is not going bang without that slide being racked first, if it is even loaded.

The important question is: Was it still loaded, or was the slide locked back & the mag empty when they got him out of the culvert?
