I'm not a pushover, but I can read.
The statement from Wanstalls above does NOT offer you a refund. Not in your specific case. You opened a package and found it defective.

Here's a lesson in basic law for you: a product sold must be fit for the purpose for which it was intended. If not, then the vendor must offer a remedy to "make you whole". That's repair, replace or refund. YOU don't get to choose. They do.
If you still think that the remedy is inadequate then you can start an action in the Prov Court of BC.
Or let Wanstalls take care if this, chalk it up to a disappointing experience, and get over it.

They shouldn't make that claim if they are not prepared to do that.

All returns require UNOPENED packaging. Its not an uncommon practice. Go try and return an opened DVD or Xbox game...

Sorry bud, but it clearly states you are not eligible for a refund. They *might* still be willing to do it, but expect to pay a 10% restocking fee if they do.

Of all things a consumer can purchase you pick DVD's and video games..of course they cant be returned. Im surprised you didnt make reference to underwear. Pretty much any where I ever shop you can return opened items of anything unless its a DVD video game of underwear.

What if this guy would only be "totally satisfied" with a full refund + 10% + a gift certificate to his favourite restaurant?

This is not how commerce works, kids.
I have explained the basic legal principle. If this dope doesn't want to listen to free legal advice then please, please start an action in the Prov Crt of BC. It would have to be commenced in the PoCo Registry. Let me know when the court date is set so that I can be there. I can't wait to hear one of you put forth the pseudo-legal argument of "whatever it takes to make sure that you are totally satisfied "and "100% guaranteed" in the hopes of getting an order for compensation, or even better, specific performance.

Please do it.

As a small business owner myself, this kind of ignorant stupidity does annoy me. Absolutely.
This completely unfair smearing of Wanstalls...in two separate threads now...is wrong.

I do a lot of online shopping, I would feel satisfied in this case if Wanstalls offer me two options to chose one;

1- Replace in-kind
2- Refund including shipping both ways.

That would be 100% satisfaction for most reasonable people living in this part of the world...

The legality of commerce may be different, and if an online retailer is willing to live within that boundary, their claim of dedication to 100% customer satisfaction is not real and can be criticized.

My experience with Wanstalls has been nothing but excellent so far, I knew they would fix this one and they did...

In business, you are a fool if you bend and capitulate to unreasonable, irrational customers.
Wanstalls clearly set out their policy. It is unambiguous. Read it and live with it or don't shop there.
Look at 99% of threads re: Wanstalls. The jury is in: their customers are satisfied.
