Type 97 Classification Issues - PART TWO

No, CBSA could release them to someone authorized to possess them. Many gun dealers are authorized to possess prohibited firearms. Marstar recieved their VZ's, they just cannot sell them.
 
Theoretically, at least, that's how it should go. The fact that CBSA has done nothing, likely means the RCMP has not made a decision. ...but what do I know.
 
Its my opinion that when CBSA sent them to the RCMP, the RCMP went: "Sh*t! We can't let people have these, we have to find a way to ban it."

They then set out to find a way to make them fire full auto. With sufficient time, effort, and a warehouse full of firearms parts they were able to make it do so. This, according to them, makes it prohib.

BUT THEN...

Clobbo messed them up by calling up and asking about the status of his rifle, the restricted.

Now they're in a bind:

OPTION 1:

If they let them through, they have lots of 'scary lookin' guns in the country.

OPTION 2:

If they ban them, using hasselwander as their basis, they have two problems:

1) They've let Canadians, for the better part of two years, possess a firearm that is prohibited by accident.

2) They can't add a new prohib class and grandfather the people who have the Restricted t97's. This means they'd have to be seized, which opens them up to all sorts of liabilities.

3) They open themselves up to litigation.

OPTION 3:

Because they don't like the other two options, they can officially do nothing, effectively keeping the status quo, until forced.

THIS is the way it seems to be going... Heck, look how quickly the RCMP made a decision on Marstar's latest shipment of VZ rifles... Look how quickly the RCMP made a decision on LeverArms Type 97 Restricted models... Lever pulled them from their shelves & you can't buy one...

It's all conjecture at this point, but my spider senses tell me that the RCMP have looked closely at the NON-restricted T97 rifles CanadaAmmo has imported, DON'T like what they see, BUT DON'T have a legal leg to stand on, and have CHOSEN to do nothing... Effectively putting the shipment in limbo FOREVER, until their hand is forced...


I have half a mind to file an FOI request.

What is required to pursue an FOI request? How does it work? Details please!

I think everyone would like to see some information about what the rcmp are doing or not doing. And if it leads to haveing someones nuts in a vice, GOOD.

have any of you actually thought about what happens when an animal is backed into a corner? it attacks.The same will happen here just let Chris do his job.We know the RCMP look at this site and what do they see over a total in excess of 2000 posts about a single gun that looks scarey and everybody wants and how cool it will be to mod out.The reason the others never got looked at was because they were under the radar. I want mine but think I probably will not see it now.as for filing a FOI instead of posturing on here and looking big I think you should have done what Chris asked and called him.not knowing what he would say I can guess and I think it would have to be stop it and stay out of it.

I agree that as a group, we tend to assume the worse. But if an issue really does exist with the RCMP, then ignoring it won't make it go away.

Yes but it seems we are the only ones that puts our plans out on display for whatever governing body to build a defense.The writing of letters to our MP's,the PM and VanLoan is a proper response to what was going on.However just blurting out whatever comes to mind and seriouslyundermine any possible legal action.Remember the saying loose lips sink ships?

To a limited extent, I agree, but in the same breath, I do believe that the "lack" of progress by the RCMP & CBSA, in releasing the Non-Restricted T97 brought in by CanadaAmmo, SAYS SOMETHING... "They" are working very hard to find the "legal grounds" to prevent this rifle from being released OR think about this... They would be just as effective, by placing it in "gun purgatory" and making no ruling whatsoever till they have their hand forced...

Forcing their hand will only come about when YOU & I, make enough noise about it... So, staying quiet is not going to work! If the RCMP & CBSA "were right", then they would simply come out with the answer, "NO" you can't have them... But instead, we have a conspiracy and can safely assume that something "fishy" is going on, IMHO...

P.S. Anyone who thinks that the RCMP & CBSA have not been thinking over EVERY scenario, is naive...
 
I just talked to someone from the CFC, apparently the gun is listed as fully-automatic in their computer, therefore even if it is semi-automatic the parts from a full auto may be interchangeable. For all we know the Type 97 could even be a converted auto. He also mentioned that bullpup rifles and bullpup stocks for rifles are prohibited (don't even get started on the TAR21) because it shortens the gun and could be considered the same as cutting the barrel.

Just because you spoke to someone at the CFC doesn't mean they knew what they where talking about. And no amount of calling will fix this, the people answering the phones aren't the people making the decisions.
