Type 97 Classification Issues - PART TWO

So Can-Am as the importer stuck in this mess and if the BC CFO is working on confiscation of those allready in circulation what is our best chance of ever recieving a Type 97 of some sort. Should we leave our money with you and keep hoping for good results or are we just swinging in the wind. I personally dont think I would by a Tavor, I dont really need another 223 it was just the right price for a bullpup configuration at Norincos price point. Your having my money is not really costing me anything so its not that that is a problem for me. My issue is is it possible that we could eventually see these or is hope lost for us?

Im curious, how did people originally get these type 97's that the govt is now removing?

When they first came to Canada, the gun type did not have to be inspected and allowed by the govt? Or did the govt fudge up originally and allow it?

The first ones in the country had restricted-length barrels. Clobbersauras, for instance, has one of those.

This bull#### didn't start until the non-restricted batch got here.

They'll send you a letter, like they did Henderson, telling you to turn it in. You can halt this by bringing a motion to review the decision in provincial court (like henderson did). I would recommend finding a good lawyer on this sort of thing NOW, and get ready.

You can challenge their finding on hasselwander, they have to meet the burden of proof that it can be converted to FA fire in a reasonable amount of time, by a person of reasonable skill, using parts that are widely available.

From What I understand the T 97's that are in private hands will remain as un classified .The rifles that are Siezed will never see the light of day in Canada

Is that official for those who already had them or will they start to seize?

I'd like to have the official source please

My guess is that if the Crown thought they might lose that arguement, they would argue the 97's as imported are converted auto, and equally unimportable.

I'd like to hear from anyone who has ever had their rifle seized. I know some guys had to give up their Spas 12's. How did it go down?

I'm sure compensation is out of the question?:rolleyes:

I've always wondered about compensation for recently made illegal things. If you discovered some sort of new drug that you thought was going to to be legal like booze but the government decided to make it illegal like cocaine AND they came and seized it from you, would they owe you compensation?

Careful guys, please don't discus anything illegal. These boards are monitored.

At the end of the day, if the CFO wants the rifle he'll get it. My job in all this it to document the experience as best I can and use it as a cautionary tale for all.

Rest assured, I will post everything I find out on this site.

I wish I'd never bought the d@mn thing now. I'd have saved myself a lot of money and stress.

So my understanding is as an owner of the Type 97: (options right now)

- If I already have the prohib class, i can keep it but if do not have the prohib class, to bad for me.
- They will not change my PAL class title from restricted to prohib class
- Sell my T97 to any prohib class owner that have the grandfather
- They will not pay back any money for their mistake
- The only other way (to keep it) is to deactivate it by some sort of process like welding, etc... as it will not be a firearm anymore.
- They will come and get it as the last resort
- So basically..Remove your pants, bent, thank-you come again

Is there any other legal options?

If you already have prohib class, it doesn't do crap to help you.

The T97 came into Canada after the grandfathering date, so there is no way, other than a new act of Parliament, that anyone will be grandfathered to keep a prohibited Type 97.

Guys, it's best not to post your thoughts regarding what we may be able to do or not do about this mess. Especially not on this site.

Harbl: AFAIK I'm not allowed to transfer the rifle to anyone.
