Sorry but no.. they cannot do that.. This isn't the movies and any LEO trying that would get slapped by any lawyer with even half a brain. They can hold you for 12 hrs but that's it w/o being charged. And there would be no grounds there for a charge to be laid. Even if they did lay a charge improperly as soon as that would be put forth in front of a JP you would be released and even duty council is competent to have such tossed immediately since there is no grounds. And to do such would leave them open for a lawsuit... something the brass really would not like since bad publicity for police harassment is not good for their careers.

ie: There is no law that stats you cannot loan such to another person with a proper license.. nor does it require you to record that persons information nor to even know them. It only requires you verify they have the proper license at the time and to loan them the reg cert or copy at the same time as the firearm in question.



You may not fight back but there are those of us not afraid to do so... as well as trying to get the insanity of c-68 abolished.

Also note.. if they try to hold you specifically ask "Are you arresting me?" If they answer yes then ask "what for?" and they MUST answer with a valid reason. Otherwise ask "am i free to go?".. if yes.. leave etc.. if no "and why not? I am not under arrest according to what you said... therefore on what legal grounds are you attempting to detain me?"

Even the most uninformed LEO will back down fast from this since if they do not have legal grounds they can't touch you.


Also note.. NEVER volunteer anything.. ask only pertinent questions as noted above. Do NOT try to explain anything whatsoever under any circumstances.

You have a right to remain silent and a right to obtain legal counsel... including more than just one phone call if necessary. Do NOT wave those rights.

While I respect most LEOs the reality is they are not there to protect you under such circumstances.... they are there to find evidence to charge you with something.
