OAL for rimfire semis is 26" correct? Non-restricted.

Taken from the criminal code:

The bold section is from the definition of barrel length.

The underlined section is from the definition of restricted firearm. The restricted firearm definition does not identify that some parts are not included as the barrel definition does. The two definitions do not over lap.

As it is currently worded, a non-restricted, semi-auto rimfire rifle, must minimum 660mm OAL with a barrel not less than 105mm in length. You can not use the "permanently attached flash hider" for barrel length minimum, but it does count toward rifle OAL.
 
You are misquoting the law....

The lower line you quoted " but does not include the length of any component, part or accessory including any component, part or accessory designed or intended to suppress the muzzle flash or reduce recoil." is for the barrel length not over all length.

Last time I checked, barrel was a part of a rifle. As stated above to muzzle. This doesnt include attachments. Otherwise a fake can would help meet overall length.
Do as you want but Id sure like to be there when you try to explain your thoughts to an officer and or judge.

Here's another funny twist (or so it seems to me).

One could buy and install a 5 inch barrel on their 10/22, mount it on any stock that is over 26 inches OAL, and still be non-restricted and perfectly legal. The barrel would not extend beyond the end of the stock, so the stock would in essence be the OAL of the rifle, and meet all requirements of the Criminal Code and Firearms Act. No where in either, does it say a non-restricted rifle is measured from stock to muzzle, or any mention of the barrel at all. They only speak to a "rifle" under 660mm falls into the restricted class. A rifle is the complete unit measured by the sum of it's parts, not individually measured components.

EDIT - At least that is my take after reading all the regulations. I am not a lawyer, and certainly open to be corrected if I have indeed missed something with my interpretation.

.....and of course only speaking to rimfire or shotgun, not centre-fire rifles.

Alright thanks for the debate and good information here guys. I have a 10/22 compact with a 16" barrel. I wanted to put a 8" bull barrel on it. As it sits its about 33.5" If i were too put an 8" on it and chop the forend down a little bit it would come in at 25" roughly. Which really brings up some of the grey areas previously mentioned. If it was a threaded barrel and I blue locktite a compensator on it and maybe a small extension on the buttstock to get me to 26" could some prick start tearing my gun apart looking to fine me? is that going to cut the mustard for legality ? Scary things aside I think it would be an amazing setup since I already have a GSG110 and a trs-25 reddot on it, its so much fun and sooo handy in the bush. Clean, light, compact and accurate making it smaller with a better barrel only seems appropriate for my first .22 project.
 
There is no grey area in cutting it down to 25", that would unequivocally make it prohibited. However adding those other parts that extend the length would make the gun non-restricted. I believe the litmus test would be seeing if the gun be shortened without tools. If you require a wrench or Allen key to remove parts, then you would be likely be fine. However, if you can simply unscrew the muzzle device by hand, it's unlikely that a determined officer would let it pass.

I have the 8" barrel with a ATI fiberforce 10/22 stock with the forend cut down. Overall length at the shortest point is 670mm. It's a great stock and only weighs 26oz.

Yeah I looked at that stock and i will say it looks good but I want to keep my wood stock and modify it to fit a heavy barrel. The compact stock is soooo light its crazy and I geneally prefer wood over plastic. Thanks for the info though Freedom. I wont be doing this mod until the summer sometime and I will do everything necessary to make it legal OAL after all mods are attached. I guess I could just get a 12" heavy barrel and that would make things a little easier but I want a super light shorty feel in a wood stock.
