On June 29, 2015, three men pleaded guilty in Edmonton Provincial Court to trafficking moose, elk and deer meat. While big game animals can be legally harvested by licensed hunters and First Nations people with treaty rights,buying and selling big game meat is illegal as the commercialization of our wildlife resources could endanger them.

And you're correct, they will be challenging the sale of meat just as they are planning to challenge treaty hunting rights on private property. Unless there's a public outcry , I can see the them getting their way, but then it's going to get ugly.

Supreme Court of Canada trumps Provincial Court and the Supreme Court of Canada has set a precedent....that provincial court ruling will hold about as much water as a sieve. :(

So why have the convicted people paid fines and gone to prison rather than appeal to a higher court?v Probably because that Supreme Court decision only specifies fish, not game animals.

Come to my home city and try and sell my neighbor, the F&W officer some moose meat, I would enjoy watching the results.
 
And I can tell you as someone who has those rights I find this kind of thing absolutely disgusting! There is no room for this kind of harvest in today's world and given our social system and handouts there is very little need for subsistence hunting except in dire circumstances. I have never exercised my rights to harvest as I have always worked, paid taxes and bought licenses to hunt within the framework of todays management system. In my opinion it is an emergency backup system should I find myself penniless and unable to buy food and even then we have backup social systems in place so I cannot see ever requiring my harvest rights. I also do not trespass or tread where I am not allowed to hunt. And as a matter of fact I rarely even admit to having harvest rights as I do not want to be associated with these kinds of people who in my opinion are nothing more than disgusting slob poachers!!

I have done a lot of work in Northern Ontario in the last few years. I have spent a great deal of time working with indigenous people. A lot of my experience is working in mines where the rotations are usually 1 week in - 1 week out. Its funny when you have this conversation:

Hi Joe, how was your week off?

JOE
It was great, shot two bull, a cow and two calfs. Did you get out hunting?

ME
No, my season doesn't start for another two months and my group of 12 didn't get a tag again this year....

conversation is pretty much over at that point. I've had that exact conversation with different people several times throughout the years...
 
Yes agreed, I think they are already on the decline because of over hunting by aboriginal hunters and poachers
I think the elders should take the initiative and start controlling the ones who making them all look bad!!
You cannot continue to kill female animals and calves, all through the years, and expect the population to keep up!


The end of game for the Native Hunters is to have non-native hunting rights striped and removed, there is a very active and scary native movement in this country,

This unaccountable destruction of wildlife is ongoing across the country..only people with no soul and no connection to the earth do this..

Who know why an appeal to a higher court hasn't been applied for? BC provincial courts ruled against the selling of fish, SCofC overturned that ruling.

Read that Supreme court ruling again, and several more times if necessary. Do you see big game mentioned, or just fish?

I was reading through the entire thread before posting and you said almost everything on my mind! My family does not abuse their rights.....and it disgusts me also when I see these things happening. Unfortunately I see it fairly often. I have personally confronted/questioned the persons who over-harvest. They laugh.....
Those who do this are not honorable, proud First Nations, but selfish look-what-I-can-do abusers of nature. Many do it for profit.
Thank you "the spank" for your comments. All First Nations peoples are not abusers of hunting, fishing, and tax related stuff like many people think.

You have a great attitude... excellent post. How many generations should be eligible for the benefits available... will the debt ever be repaid?
