Can a store keep my fully transferred handgun from me

Guns can go Canada Post, then there is no issues with remote town delivery.

Costs remain somewhat constant with price increases well publicized before implementation.

So if I sell a gun on the EE with shipping included like I normally do , an NR for EG. to someone 4 provinces away and then say I need $20 extra for shipping as I screwed up the costs, now what ? if he refuses ??

I keep the gun ?, its the buyers gun just waiting for him to get if he refuses to pay the extra $20 ? is this a new way to make an extra $20 on every sale ?

Agreed, Tenda asking for more insurance money after the deal has been made is sleazy and if one of us did the same thing on a private deal, it would be sleazy as well and would be grounds for a “negative” on the sellers EE feedback.

For those saying the OP is wrong for selecting UPS for shipping. It is not the responsibility of the buyer to know the policies of the shipping company. No where does it state on Tenda's shipping policy that firearms must be shipped via CP. Tenda should not offer that as an option when checking out with a firearm.

Also, the fact that Tenda does not respond to this thread or alligation says something in its self. Good customer service would be to ship this guy his gun, with the full insurance and eat the $15 and then update their shipping policy so this does not happen again.

The term pyrrhic victory is really applicable here. The OP could very well never see his gun. While Tenda does have a legal requirement to forfill their end of the deal, there is really no way to enforce it. The Op could call the police and report that Tenda "stole" his gun. They may go over to the store, interview the owner and then decide it is a civil matter. As long as the gun is accounted for and securly stored they won't persue it any further.

Tenda could close its doors tomorrow. No more response to emails/ phone calls. Insolvency, bankrupsy, seizure of assets etc. Any of these things could happen and the pistol would get lost among the shuffle.

It's in their Terms and Conditions https://www.gotenda.com/terms-and-conditions/

While it's not the responsibility of the buyer to know the policies of the shipping company, it become entirely the buyer's responsibility once he buy an item, because it's a tacit agreement that he accepts the terms and conditions.

Our shipping department has determined that UPS will be the most affordable choice in shipping for this order.

While we have already covered the basic shipping fees and some additional costs, there will be an extra $9.32 extended area fee that we are unable to cover due to your location.

May we charge that amount to your original payment method?

Lol, I've seen that before!

I have had situations where I sold something for an agreed price, including the shipping, only to find out the shipping will be more than I anticipated. I ended up eating the cost. I am not a firearms business but I was a business owner in the past and I understand the value of a good reputation and know that good customer service leads to repeat customers.

This whole issue is over shipping insurance - shipping insurance is the big scam perpetrated by the shipping companies and too many people fall for it.

The issue would be resolved if the OP understood the civil laws around retailer liability (not to mention his credit card terms and conditions) and just cancelled the insurance…plus he’d get a $9 refund.

emails threatening me and my property

I would ask for a 100% refund plus interest, no exceptions... even if it means going to court.

NOT TENDA story: I bought a synthetic stock long gun during a sale with a not tenda CGN vendor during a "use a discount code" sale. One or two days later I got a phone call: the not tenda CGN sponsor said the long gun was on sale and somehow there was a computer glitch and it allowed a sale on top of a sale. The not tenda CGN sponsor refused to sell at that price.

I complained that it was on them and I should not be responsible: that I can't be on the hook for the $50 mistake they made. After their "we're a family run business and you can't force us to lock our doors" crying and whining I relented. On the order was also a few other small items including a 3 pack of PMags.

The rifle showed up a week later in the manufacturer's box with zero packing, no cardboard dividers, nothing in the box to prevent anything from moving. The muzzle put a hole in the box at some point. The stuff inside rattled around so hard (Canada Post throwing it?) the receiver of the long gun broke a PMag snap on cover. How F*N hard does something have to rattle around to break a PMag?

When it arrived I gave up. I never complained: I didn't want the fight with the whiners. I have never once bought anything from them since, nor allowed every gun owner I know locally to do anything but spit on that not tenda CGN sponsor.

Luckily, being a steel and composite stock long gun I was able to strip the firearm down, re-bed it, and it shoots as good as that make and model can.

I wish at the time I had asked for a 100% refund and slathered them with bad reviews everywhere on the planet.

Don't make my mistake.

100%

Everything I post on EE is shipping included price. I don't even check into costs before posting. If it sells to someone 50km away or 4,000km it's just part of selling used and a few dollars isn't changing anything. There is no chance I'd change a deal after it was agreed on.

So Tenda is holding you up for $15-$9.09 or is the total $24?

For $15 I would pay and bad mouth them everywhere and not do business with them again. They will lose a lot more than $15 over their stupidity.

This is exactly it. Industry reputation and a good worth of mouth precedes dollar figure and is immeasurably more valuable. And honestly, I have had more than a few instances selling stuff where I underestimated something or neglected to consider a cost. In ALL cases, I just ate the extra cost, sometimes significantly (recently I sold a Mossberg stock to someone, saw what province they were in, and just gave them a shipping charge where I sent something to that province last. Well, it was a J0x postal code, so rural, and when I punched it in with the weight, dimensions, etc., it was $19.60 more than at I had quoted the person. At no time did I consider asking for more money. It was my problem that my estimate is off, and whatever the cause, it is on me so I ate the extra costs, and learned a lesson about the fact that not all places in a province incur shipping costs plus or minus a few bucks. I will check with the buyer's postal code next time before giving a quote.

In this case, I have to say that the onus is absolutely on Tenda to honour what was originally agreed to. If something has changed on their end with their suppliers, vendors, etc. which increases the cost of insurance in the interim, it is absolutely ON Tenda to absorb the extra. I don't care if it is 50 cents more. The customer bought and paid in good faith and while I have had a relatively good experience shopping in person in Tenda, I will think twice now given what I have read here. Business integrity is very important to me, and retailers that exhibit it will consistently get my business. There are many instances where as a business, you just have to honour the original agreed upon terms of purchase/sale, even if it comes a personal expense. Good businesses recognize the value of their reputation is GOLD and will do everything possible to ensure that they earn their customers' trust.

I wonder what will last longer, the CGN commentary or the OP's will to resist paying. I bet Tenda doesn't give two ####s. They will prob sent the Op a bill for storage fees too.

so still no gun ...

No gun sent, they refuse to respond to my inquiries and altho I don't want one they have not refunded me my purchase so they have my gun and my money and refuse contact with me:popCorn: So ya Tenda is a POS store that I will never ever deal with again and still waiting to see I guess what happens

Call the police and report the firearm stolen. While reporting, tell them that you know exactly who has it and send them to Tenda's store.

Is the gun paid by CC ? I would get the transaction reversed with the Bank.

The problem is that the OP probably wants the gun and does not want to cancel the sale. We were the same way with my wife's gun, she wanted it and no one else had another one for sale, so she caved and paid the extra shipping insurance fee ($32 in her case). It has now been a full week since her transfer was approved, and so far no word on it being shipped. I am hoping that the gun gets here before the Registration Certificate. LOL.
