Another update to my land issues... Several people charged with various offences

Handcuffed and held for a summary offence ?

Handcuffs are for an indictable offence.

Best of luck.

Handcuffs are for anyone arrested. Criminal Code Summary offences are arrestable under certain circumstances and not arrestable under others. But ANYONE who is arrested should be handcuffed. Some people don't like it, but that's the way it is.

I hate trespassors wth a passion and would never in a million years consider trespassing. That being said, I'd never allow myself to be cuffed by anyone other than a police officer or my wife and certainly not out in the middle of the bush, landowner or no.

I agree with those in this thread that are suggesting re-thinking the whole hand cuff thing. You approach trespassers and pull out a pair of cuffs, I think things are going to escalate in a direction you don't want.

I'm cheered by the fact these douche-bag trespassors were caught and charged though.

Trespassers and vandalism is one of the main reasons I won't buy a piece of land to build myself a hunting cabin on even though it's been a life long dream of mine ...people just don't respect private property and if you don't or can't visit it regularly, you are at their mercy..

Set up traps, for the trespassers. Humm armed men trespassing... lots can happen, you did the right thing to be honest. That being said leave a bottle or rye there next time and fill it full of piss.

Well OP, here's a more positive spin on this situation. In my experience (had similar issues with the locals), the ones who were charged will probably not be back. Too much trouble for them and easier to go trespass on someone else's property. They will talk crap about ya, but that's about all. I found there are two types of locals who tend to trespass. Those who reside in the immediate area of your property and those who are a still local but a few miles away. Sounds like you had the latter to me. Neighbouring locals can be a real PITA as they treat the place like their own. Best to keep them in good company and slowly train them into your way of thinking and/or put them to work if they plan on using your property. You might be pleasantly surprised how little they want to use it once they are expected to contribute in some way!

As for having hunting cops on your property, why not? Hunting cops are on the same side as law abiding hunting non-cops!
Good luck!!

Look at it this way. You're out for hunt and suddenly, here's another person coming towards you ranting and raving, not in any recognizable uniform, claiming to be some owner or owner's rep waving a pair of handcuffs yelling and threatening like an idiot. Are you going to simply stand there while this nutbar whom you have no clue as to who he is or what he's about applies handcuffs and takes you prisoner? Anyone thinking this would be OK is in serious need of psychiatric help. That kind of stupidity would be epic. The nutbar's day is going to get really bad, really fast,if he doesn't get himself shot, outright. Now,I'm sure there's going to be some rent-a-cop wannabe that graduated from a two year law and security course that thinks he's a lawyer that will be all full of himself and say,far and wide, that this is wrong, illegal, blah, blah, blah, cherry pick sections of the Criminal Code to belabor his point, but, case law in Canadian Courts has exonerated many a person who found themselves in just this situation. I say to those folks that the old adage is true,"A little knowledge is a dangerous thing."

My friends hunting cabin that I go to is south of Bancroft and we always see the locals with their camping chairs along the roads waiting for deer to cross

They do that too in Bancroft? LOL. I see it all the time in the Parry Sound area during deer gun season.

The good old strawman argument and name calling. Got to love it when the slow are unable to comprehend the conversation.

On my property it is shotgun casings and beer cans. I have amassed a big pile of cans. Next time I am up I will haul them to the beer store. I may as well grab a few cases of beer for my troubles.

Nail them hillbillies to the wall. I hate slobs like that. I hunt a 400 acre property on a No Maintaince road in 81B and have kicked many people off it. Land owner is ready to tell everyone to #### off he's so sick of his property being a free for all. I have all these people charged with trespassing.

I caught a guy with his rifle sticking out his window with electronic caller on the roof. He didn't like me taking pictures of him....haven't seen him back after he talked to the game warden and 2 OPP officers.

Years ago I inadvertently trespassed on somebodies private property ,I went in on an unposted piece of land, got turned around and came out on the back side of a guys place,I crossed no fence lines or anything that would indicate I was on private propertyuntil I came to a dirt road and was walking down it .The guy came out ,screamed and yelled and threatened me, and told me to 'get off his land' ...in spite of me telling him I was lost and all I wanted to do was get back to my truck ....so that can happen too.

Play stupid game, win stupid prizes. happy to see some charges and fines here.

If that was my land it would be posted too.
