Antique handgun carry as sidearm?

A Perscribed Antique handgun can be "in use" anywhere its legal to discharge a non restricted firearm.
Thats all you need to know.
Makes things simple.
You cant conceal it you cant hunt with it in most provinces.
Your reason for carrying it should be that you like target shooting.
you can target shoot a antique revolver anywhere its legal to shoot a none restricted rifle.

Its no use phoneing everyone asking about this that will just draw attention to the antique gun rules.... leonidas is right!

Transport and use regs are there to be read read them there abit hard to follow but all the info is there maby someone can post a current link to the transport and use regs as my link is to old to work.


Anytime a antique revolver/handgun is used in and ilegal manner it becomes modern in the eyes of the law.
So do something stupid and you will be charged as if you had a brand new modern SA pistol.
Thats why theres no stats on antiques and the crimes commited as soon as theres a conviction the guns not considered antique anymore.
Guys that shoot in graval pits to close to town or are careless can be charged with careless use of a firearm because if your breaking any laws with the antique its not a antique anymore.

It would be a good plan to read all the stickys theres years of experience up there from alot of diffrent guys on CGN that know alot.
anyone getting into antiques should have to read the stickys.

My point is that this area of the law is fairly clear as read but is not widely known outside of shooting circles... And perhaps that is for the best unless we want this particular "loophole" changed.

Dingus wins the cake. The general consensus is to use common sense and not be a d*ck about things.

To the OP, once you own antiques and have experienced the stuff a lot of owners put up with you'll understand the defensiveness and hostility from some members. They're mostly tired of similar sounding questions from people who are clearly not proper firearm owners. As well, there are ways to phrase questions online so they can't be misconstrued. Best suggestion is to just spend a lot of time reading and talking with local knowledgeable gun owners. If you don't know any knowledgeable gun owners, make it your quest to get out and meet some - there are lots of good people out there who can help steer you clear of pitfalls and give some really good shooting tips! :D

As clarification to the above:
  • An antique IS NOT a firearm for the purposes of the firearms act and doesn't need a PAL/POL or ATT.
  • An antique IS a firearm for every other purpose; including transportation and discharge.

Pretty black-and-white to me.

There is a caveat to those rulings. Many of the laws prohibiting carry of firearms were created in cities before many of the prescribed antiques were made. Those laws supposedly still cover the prescribed antiques in question.

Suffice to say, if you carry any firearm, prescribed antique or not, in a municipality or urban area these days, you can just about bet you will have the firearm confiscated, charges laid etc.

Just because the firearms act doesn't specifically list prescribed antiques as firearms, they are capable of discharging projectiles at certain velocities. Even low velocity pneumatic firearms are prohibited from use or carry within municipal or city limits by legally passed ordnance laws that supercede federal and even provincial laws.

Bringing attention to this will not really stir up a lot of trouble, other than with a socially engineered bureaucrat, but it isn't in anyone's best interest to start rubbing noses in it either.

Use common sense. How often are you stopped and searched for anything???? If you're one of those individuals that is searched on a regular basis, again, you're just begging for trouble.

Common sense is your friend. Testosterone attacks will land you in jail, maybe with charges.

Lots of people carry concealed weapons for lots of different reasons. Most don't even attempt to get proper documentation, not that they could anyway.

Bringing unecessary attention to oneself isn't always a good move. At the very least, it will get you "red flagged" in your FIP file.
 
This kind of stupid will end the prescribed antique fun for everyone.

Those are all stickied at the top of the antiques forum. Reading them could have very well saved you those hours you spent on the phone and would have given you hard proof should you desire use of your antique in a legal area to do so other than a range.

Don't forget that being told something on the phone isn't hard evidence unless you were recording the phone conversation.

Also civil servant or not the less attention we bring to the antique hobby to those not already informed of the allowance the better. If you really require to hear a calming voice on the other end of the phone stop calling every agency known within Canada and do the following;

Press 1 for english
press 1 for the extension,

thanks Leonidas i appreciate your time.. but i am calm.. and we pay alot of tax. we can call everyone in ottawa if we want... they work for US... they kept on transferring me because nobody was qualified to give me an answer...try it yourself...

There are lots of people qualified to give you an answer but they have no reason to need to do so.

Here's how to get your answer - strap two guns onto your hips and take a walk down Yonge Street and see what happens next. I bet you find some police officers who will give you an answer quite quickly. If you don't like the answers the police officers give you just inform them that you might fire them, because after all - they work for you. Let me know how that works out, too. ;)

It means you should go take your PAL course if you don't understand that.

Read the stickies, take your PAL, and enjoy the hobby responsibly. This thread and your subsequent questions are passing the smell test less and less.

Why don't you just give the answer? I am not playing games, just want it put in layman terms…

In a nutshell - many actions that are illegal with a modern firearm are not with an antique.

Previous versions of the law defining antiques were less than helpful with respect to cartridge handguns. The current law and associated regulations are much better, although do incorporate anomalies.
It was NOT the intent of those who drafted the current law and regulations to facilitate going armed with a handgun.
Amending the law would require legislation; changing the regulations (which have force of law) does not. For example, it would be very easy to amend the caliber list so that only firearms originally manufactured in off-the-list calibers would have antique status. Those altered to, say, .45ACP or .38 Special would no longer be deemed to be antique.
Antique handguns should be used in a thoughtful and cautious manner.

First off… I did not create the law in any way shape or form. I am being a safe firearm owner by following the RULES 100%. If the law was clear as day for antique handguns, like it is for my restricted handgun. None of us would have this conversion. You can not carry a restricted handgun firearm out in the woods But some people say you can if is a antique. Safity is number 1. Lets work together to find the answer…

It is not illegal to have an antique handgun anywhere you can legally have a loaded non-restricted firearm.
Having said that, it is highly unlikely that any law enforcement officer - police or game - will be aware of this.
At the very least, you could be greatly inconvenienced.

... Assuming this was intended as a legitimate question: Firstly the Antique Status only involves the Firearms Act, IE Not requiring Registration and Permits to transport etc.... It does NOT apply or have any relevance to the CRIMINAL CODE. Thus, it is a weapon, and the Laws pertaining Concealed Weapons and Firearms specifically are applicable. ... Thus it's manifestly ILLEGAL to run around Town with an Antique Webley in your Pocket fantasizing you're Sherlock Holmes or Dr.Watson. .... :popCorn: .... David K

Guys when an OP asks if he can carry 2 loaded holstered antiques do not humor him.
Anyone who cares in a legitimate way to understand the regulations governing antique collecting will come with questions AFTER having read at least a couple pages of CGN threads.
