I originally posted this in the pistol thread but apparently it has been moved to the Tenda thread now so I feel I need to clarify a few things because of this change. I did not mention Tenda in my first post I just asked a question about ownership but it became very apparent from the posts people just said Tenda on their own which goes to show this is not an isolated incident and their business practices are well know so I did confirm later it was Tenda.
So here it is more of an explanation I was looking for a CZ P-07 and so I made the purchase from Tenda as they had them in stock at the time. I paid fully on my credit card and chose UPS as the shipper as I at the exact same time had also purchased a CZ P-10SC from another store in Ontario using UPS ( YES I really like CZ pistols )
$879.99 - P-07
Free Shipping
$9.09 - Insurance
$44.00 - GST
I fully paid $933.08 for the P-07 and the sale as completed and the transfer initiated, Fast forward ahead to after approval of transfer and we then come to the issue. Tenda sends me a message that they have changed the shipping from UPS to Canada Post and that I must either wave shipping insurance and ship $1000 purchase uninsured or give them an additional $15 or they will cancel the sale. I replied that I had already paid for insurance and they had switched the shipping company not me so in my mind they should make up for the difference on their end especially how they had already increased the price of the P-07 quite a bit from what they were selling them for only 6 months earlier I felt it was on Tenda not me.
They messaged me back saying UPS does not ship to my city of 70,000 people in Alberta and I have to pay the $15 or decline insurance, Now as I previously said I had also purchased a P-10SC from another store and that transfer also went through at the same time and that store was shipping using UPS and that shipment went through and they gave me the tracking number for the shipment so I messaged Tenda saying that UPS does indeed ship to my city as I currently have a P-10SC being shipped to me at this very moment. Today I have my P-10SC in my possession as UPS did in fact deliver it to me with no issues at all
Tenda then again told me to decline shipping insurance or pay an additional $15 or they will cancel the sale revoke my registration and resell the P-07 and I had till monday to decide or they would revoke my ownership. At this point is when I contacted the Ontario CFO and we had multiple discussions but to boil it all down to this from the head boss CFO, There is no legal requirement for the exchange of money in regards to transferring firearm ownership and any money issues is a civil matter that they will not get involved in. The P-07 was legally transferred to me and is registered to me and that is their position on the matter. A store can reverse registration if it is the buyer who is the one who cancels the sale and returns the firearm to the stores ownership but in this case I am not canceling the sale and giving up my ownership and that is were the real difference is in regards to having a store "take back" a firearm.
Now I know its $15 and paying it would have prevented a lot of issues however with that being said my position is that I have done nothing wrong here I already overpaid for a handgun that 6 months ago they were selling at a much lower price and making their profit and I did pay already $9 for full insurance and the fact their position was pay us or else we take your gun and just resell it and there is nothing I can do really really ticked me off so that is why I am not giving in to basically extortion / kidnapping and just paying more to Tenda.
Well that hopefully clarifies some things
Assuming that this is what actually happened as we don't know what Tenda's side of the story is.
One can choose either to look at it from the miniscule $ figure, pay it, and call it a day.
On another hand, OP chose to approach this from the right and wrong principal. Sorry for digressed a bit here. Many of us wondering why we are where we are right now. Using recent example of what happened at Oakville school. The conservative and the right always looked upon as the "nicer" or sometime timid group. We rather tolerate a bit though it is wrong to avoid confrontation and preserve peace. Look what is happening now all around us. IMHO, it is one of the results of people giving in bit by bit even though it is wrong just so we are being nice. Every time we compromise even a little bit and agree to the opposite even though that they are wrong, we don't get it back and they continue to gain the momentum.
Yes pay the $15 to avoid the hassle and move on, IF what you care about is only the $ figure and time, and you desperately want the gun now.
Don't pay the $15 IF you stand for what it is right and wrong.
On another perspective, again assuming OP's side of the story is the only fact, Tenda could have just waive the $15 (cost of a food court meal now days/worth few days worth of coffees), avoid this hassle, and learned from their shortcoming.
At last, sure people know that someone/something/organization/government is only in power ONLY IF people give in and allow them to be in power.
If you stand for the truth and right and wrong OP is the reason why you are doing this and this is the only side of the story, I commend you for it. God bless!
