It seems Type 81 is coming

Fair enough. You have me there. It just makes me sick to see people just accept things the way they are going. I want to see some united action from firearms owners BEFORE the police/gov't take our rights and our guns away.

Won't happen. Just look at all the gun owners here. We aren't even unified on this website. Imagine the rest of us that aren't online.

It is always the motivated few that do the heavy lifting.

How is the firearms act calling he shots regarding the type 81 and the CZ 958 ?

Go read the section that speaks to what firearms are prohibited, which are restricted, and which are non restricted. Classifications are based on those definitions within the law. The RCMP then publish their opinion based on their examination, and how the findings of that examination speak to the classification parameters as set by law.

Law written by politicians.

Don't like what the lab is doing? Get the firearms act change by the politicians.

The 958 is non restricted. Just like TVPP video. Click on the link, and watch the video. I'm guessing you still haven't since I last suggested it to you.

"Firearms are classified under the Criminal Code and its supporting regulations. As such the RCMP does not have the authority to classify firearms. However, in order to fulfill its statutory role of registering firearms, the RCMP must form an opinion as to the classification of a firearm if the classification is not explicitly set out in the Criminal Code and its supporting regulations. This expert technical opinion is captured in the FRT."

That is not how it works. The law is written by bureaucrats on behalf of politicians and interpreted the rcmp.

There is and never will be any FRT information. The rcmp don't want to go down that road, they have no need to go there when they already have what they want.

Wrong.

There is legal recourse against public institutions which (either purposely or by pure incompetence) delay doing their work and thus keep citizens in limbo, when said delay is deemed "unreasonable". There is a LEGAL OBLIGATION for public institutions and organizations to deliver the services and/or decisions they are tasked with delivering, with absolute objectivity and in a timely manner.

See: http://en.wikipedia.org/wiki/Canadian_administrative_law

In essence, they cannot stall doing their jobs forever or take partisan decisions (or tactics). Therefore, the RCMP gun lab will have to make a well motivated decision on these firearms' status soon or will likely end up in front of an Administrative Tribunal... if importers decide they've had enough of being dicked around, that is.

Only problem I see with this is a)the rcmp couldn't give a rats ass b) what's it going to cost the dealers to take them to court and get a hearing.

A) They have no choice but to "give a rat's ass". It's the law and they are required to abide by it.

B) Nothing, if the dealers can read the law and make a founded complaint. Or they can lawyer up. Their choice.
