Right or wrong...looking for answers according to the law

A friend of my wife found out I hunt. She proceeded to tell me how they eat deer all the time. How they pay for an extra tag so that their friend could hunt a deer for them. then she proceeded to ask me if I could do that for them too.

It is my belief that this arrangement is illegal. I am not so interested in peoples feelings or what they think what the law should or should not be.

What i am interested is whether this arrangement is legal or illegal according to existing laws.

In Sask that would be illegal as it is akin to paying for wild game which is a big no-no here. A fellow from my home town gave away a deer and his buddy who gave him a bottle in thanks , they were overheard in the local cafe and someone turned him in and he was convicted.
 
If the tag is in someone else's name, and that person is not there when the deer is shot and tagged, that's a no-no. If all they're doing is putting up funds so Hunter-X can buy a tag in Hunter-X's name, that's probably OK. Hunter-X can give his deer away to whomever he chooses, he just can't sell it.
 
if your wife's friend that bought the Lic in her name accompanies you on the hunt, it's a green light or if she is just paying for your Lic for you, that is fine. You can give away your meat.

there was a time in the last few years that we could buy 7 tags and shoot up to 7 deer in a season ,if I was to give one away what is wrong with that .if someone wants to give me the 30$ to spend whats wrong with that .now filling a tag that is in someone else name when thy are not hunting or just having another persons tag on your person is a big no no .so it may be totally legal or it may not be just depends how thy went about it Dutch
 
I believe, but am not sure, that the animal would have to be processed before it can be given away. IE you can't just drop off a deer fresh from the bush. After it is butched, it can be given away to someone who doesnt hold a license.

Anyways, MNR has an "ask a CO" email/link which they are fairly quick at answering. I'd search it out. Or just call your local office and ask to speak to enforcement.

I could see "giving it away" I believe there may be some legality involving "SELLING" game meat.
 
again there is no law about giving someone 30$ and there is no law against giving some one a tagged deer ,I believe if you give someone a deer you must leave them with your licence info .and I am sure there is no law saying the deer can not be intact I never heard of it anyways .just leave the folks the deer with all the hunter licence numbers and contact info and I am sure it would be all good Dutch

Never heard of that before. As long as its tagged properly.

The purchase or sale of Ontario's fish and wildlife, including angler-caught fish, taxidermy mounts, skulls, meat, bones, antlers or live animals, including mammals, reptiles, amphibians and insects is, in many cases, unlawful, and could result in serious penalties.

The Ministry of Natural Resources enforces laws related to the illegal trade in fish and wildlife. The Fish and Wildlife Conservation Act provides for penalties of up to $100,000 and two years in jail for persons convicted of these types of offences. Even heftier fines, of up to $250,000 and a year in jail for one offence, or $500,000 and a year in jail for a second or subsequent offence, are possible under the Endangered Species Act.
 
You could report her to crime stoppers and if she's convicted take the reward money and buy a gun from the EE. 2 out of 3 parties win :)
 
the party is not buying meat giving it away is fine .seems to me someone may be feeling left out .did you not get a deer yet yomamma .trust me if I knew of someone that was selling wild game I would be reporting it for sure but in this case I would not worry about it ,D

I'm not worried about reporting people...this is a discussion on what the law is. To find out if my understanding of the law is correct.

And yes, yes I did get my deer this year. Thanks for caring.

And yes, in the eyes of the law someone is buying.....money is exchanged for the express purpose of obtaining a deer....

now you say you got your deer and it's in your freezer, fine, and the friend wants a deer, she can accompany you on the next hunt with her Lic in her name, and that's it! Your can "party hunt" together and shoot her a deer and gut it for her and drive her home with it, hang it for her, skin it for her, kiss her good bye, and whatever else you wish to do. No other money should change hands "for the meat", which does not make a "selling of the meat" conclusion! How hard is that to understand?
Is she wishes to compensate you for your time and the cost of gas and trip expense's, simple refuse to accept anything and your good to go, if you are worried about it! I know, you just wanna know the legality of it, so refuse any tips, but I sure wouldn't turn down a huge hug and a big smack on the lips for your kindness!

To clarify...a non hunter paid money so a hunter could buy a another tag for the sole reason of providing a deer for that non-hunter

Is anyone here a lawyer? Then these are all just educated guesses. Regardless, they could still be charged just to be acquitted later. Don't ask the internet for legal advice.
